We had our interview this morning, April 13th, at Mumbai embassy. I flew abroad from Oregon to attend. We have a solid relationship, history and madly in love but have children to consider and bills to pay so the  K-1 was the fastest (at the time) option to be together and get settled. 

 

My fiance was questioned about how we met, the timing of his divorce (failed arranged message from 12yrs prior and divorced a month before we applied). The officer looked at a few photos, questioned him again about his divorce date and issued 221g with no additional information. He did not ask about our children, life plans, etc.

 

After we left (heartbroken) they called him back to embassy for fingerprints and took his passport. We now must wait for contact regarding next steps and no input on what or how to prepare. One thing we noted during document review was that he took local PCC rather than regional PCC from passport office.

 

Questions:

 

1. They now have his passport so if we order proper PCC online will get accept copy of passport to pick up PCC?

 

2. Where can we submit new PCC against our case in AP before they call on us to submit?

 

MOST IMPORTANTLY, has anyone else been through similar and have a timeline or experience to share (with focus on divorce - two for me and one recent for him- or PCC issues or similar officer behavior at interview)???

I'm not 100% sure about the PCC... but I would imagine you should be able to get appropriate copies of what's requested to send to them with no problem without the passport. They take the passport because they basically feel the case is approved, so long as they receive what's needed, so they can go ahead and issue the visa once it's received. Similar situation happened for my fiancé, only with his papers from the doctor who did his medical. They kept his passport after the interview and once they got the papers, his visa and passport were mailed to him pretty quickly.

 

As for the focus on divorce - yes, that's normal. And considering there are multiple divorces between the two of you, it's not surprising they had an interest in it. Nothing against either of you, but they may look for any sort of pattern with regard to multiple marriages before approving the visa. I have never been married, but my fiancé was married once before. His divorce decree was actually the only thing out of everything he provided at his interview that they kept until the visa was issued. I assume for further verification. So I wouldn't worry too much about that.

Your response just lifted our spirits exponentially and can't thank you enough for the input.

 

On the divorce subject it would have been wonderful if they just asked...mine due to spouse addiction issues x2 and his a failed arranged marriage after 12yrs of trial and hard work to accept his fate. I love our story and sharing it with others because we proudly support five children together globally (one step, one adopted and three natural)...but the consulate officer didn't ask or allow for open discussion. That part makes me sad because the emotional connection and love doesn't come through on paper so well!!! Xoxo

I completely understand! It's hard throughout this process, because most of the time we're seen as case numbers to these people who review it. They don't know us as people, and most importantly as a couple. It's hard to convey that part of ourselves on paper, as you said, and in evidence. At the end of the day, they may think we look like nice people or find our stories interesting, but there's still factual bases they have to review and consider. They're just doing their job. :)

 

It's a very common thing, to have to provide something extra or wait for something to be verified at the stage that you are at, so don't worry! It's not an unusual speedbump. Albeit a speedbump, which is annoying regardless, but not an abnormal one. :)

Oh no! I'm sorry to hear you guys got a 221G, Annie! But I do think it's a good sign that they kept his passport. I would try to get the Regional PCC with a passport copy and if they issue it, maybe call or email US Travel Docs and ask how it should be submitted? I hope this gets resolved quickly for you guys!

Thank you, Julie. We will prep and make the call on Monday to see if we can help expedite any review...if that's the core issue. Hope that everything is going well for you both and congrats on the start of your new U.S. Journey together!!!

Update:

 

Regional Passport office would NOT accept copy of new passport + prior passport to issue pepper PCC. We we haven't received a response to our formal email request sent April 17th (and scripted answer to our four phone calls) about how to obtain or get original passport back from embassy. I met with my congressman today in Oregon and lodged a request for formal inquiry into our case with a copy of all documents.

 

While they cannot influence the decision process they can pressure and monitor the responsiveness, treatment and resolution of the case. My congressman is particularly passionate about new legislation to cut through the beurocratic BS pertaining to this process under our current administration. It sends a pretty strong message when your congressional representative hears that you were embarrassed to be an American sitting inside your own consulate abroad after watching the poor treatment of your spouse/finances citizens.

 

We'll keep grinding away at it and find a way!!!

What’s the difference between local PCC and regional passport PCC? I live in Gurgaon and am getting my PCC from local police commissioner headquarters. Would that be okay?

Hi Amit,

 

They will not accept local PCC (we are in adminstrative processing because of it since April 13th). You must go online to regional passport office, register, pay the 500INR fee, schedule appt and go in to pick up your PCC. I can only presume that the regional process is "government sanctioned" whereas local districts can be influenced (especially around election time). They will mark your file incomplete at interview and put you in AP status. We never saw, in all our research, anything that stated it had to be regional but we've paid the price so hopefully this advice helps you!! ;)

Omg, this thing never seems to stop. It’s like a rollercoaster ride. I was almost on the verge of getting it from local PCC. 

 

What website is it for regional passport office? I looked online but can’t find any info on PCC. I did find PCC stuff but on ministry of external affairs website.

Ha! I found that sometime ago and literally just paid and am going for appointment on Wednesday. So if I take docs and all, they would give my PCC the same day? That’s pretty quick. The PCC I was gonna get from local police place was asking me to get signatures from neighbors and all. I guess that’s not the case with this regional office? 

 

And I really really want to thank you so much for making me aware of this thing. I would have been messed up if I didn’t come across your PCC post on this thread. Thanks much, Annie! :) ... and what’s your guy’s status as of this moment?

It is hard for someone else to understand the real pain and suffering what people go through. There are genuine cases and at least they should be able to differentiate between genuine ones and false ones. Well same here failed marriages because of arranged marriage and did not work out as she was not interested in you from day 1 or another one was an alcoholic and your fate brings to this stage where you loose money, family, children and everything and you want to truly find someone for yourself. You marry in America, they run away to another guy. You marry from your own country they have issues. It is hard to find good people. But, that is life's choices. My story can be taken as a movie. What to do life sucks.

Getting into somebody's head as to their actual intent is extremely difficult to impossible.

It is the beneficiary's obligation to demonstrate and convince the CO that it is a genuine relationship.

That's where front-loading of genuine documents comes in. India is referred to as a high-fraud country in effect because of the tendency of bad apples to lie and procure counterfeit documents, and less than a bonafide relationship. COs have to weed through the false ones to get to the genuine ones.
