Your AOS will remain pending until your i360 is approved, the current timeline for i360 approvals is 16-18 months or so from receipt date. Once your i360 is approved your AOS is transferred to your local office.

Here is my story I arrived in America on April/4/2017 and got married to my wife US citizen on April/14/2017. Our every day was getting spent like a dream for me and my wife and we figured out my wife is pregnant on May/05/2017. 

 

I felt like it is the best time of our life but, as soon as my wife got pregnant my life became hell. She started to give excuses to avoid me like my body temperature is very high so she can't sleep me in the same bed. 

 

She never filed any paper's for me and started saying I should look out for a job, she said I am a slob who is good for nothing and no body her family loves me or care about me and I should do everything by myself because she will not be around forever.

 

She used to make fun of me in front of her friends and that was humiliating and I always felt devastated. When I asked her to move out from her friends house and let's find a place for yourself she said I am abusive because I want to separate her from her family. I just couldn't do or say anything to it.

 

This happened for almost the whole month of may. On memorial day after dinner I was asked to come to the dinner table and her friend said there is change in her behavior after I arrived in the USA. I didn't like it so I asked my wife who is a US citizen she said I am to stupid to understand anything. 

 

And later that day she came to our bedroom and started yelling at me saying it was a sham marriage and I only married her for green card. I said I came all the way to USA for her I love her but she kept on going and threatened me of deportation. I couldn't believe what's happening with our life I couldn't sleep that entire night. 

 

Next morning she said no one from her family wants to see me there so I should leave right away I asked her why is she doing this to me so she and her friends started laughing at me. 

 

I was in such a state of mind where in I didn't knew what should I do or not to do. Because our separation was like a shock to me. I had no option left rather then to leave her house. I didn't knew what is next or if I can do anything about what has happened with me. I called my parents and close friends telling them I am coming back. I only have 2 friends here they suggested me to stay and talk to a immigrantion lawyer.  

 

I flew to a different state and I received a message from my wife on 06/02/2017saying she had a miscarriage and she had a appointment next week. So I asked her how did that happen and I stayed here for our child and the next thing she asked was my address. After a month and a half her friend reached out to me asking if I am willing to pay the child support. Which was like a surprise to me because my wife never told me until then there was no misscarriage.

 

Which I was scared to provide so I didn't respond to her. I was going through a lot emotionally so my friends helped to get me to a therapist. Because all I used to do was just sit and cry.

 

I reached out to a immigrantion attorney and told him everything and we did concurrent filing in November. I recieved my work permit in January this year which I am glad. And as advised by my lawyer I filed for my divorce but, all of a sudden my wife started to reach out to me after six months stating she gave birth to a boy and we should be civil together giving him the best time for his life.

 

Which I appreciate and thought of talking to her because I always wanted to save our relationship and I gave everything what it takes to save it. But she said she doesn't want to be in a relationship anymore and started to send me images of our child mentioning it's her property and I should not use it.

 

It's like hurting my sentiments getting to my nerve that I want to see my child and on the other side she threatens me of deportation. My situation is so much depressing which I can't explain.

 

My lawyer advised me not to talk to her but, I don't know what should I do because if I ignore the messages about our child then I become bad and even if i do communicate to her then also I am in trouble.

Timeline

A few things come to mind:

 

1)  It's good that you have an attorney.  I would follow his advice and have no contact with her.

2)  If she lied about having a miscarriage it's also possible that she could be lying about the child even being yours.

3)  If you continue to maintain contact with her, you are enabling her to have further control over your mental and emotional state as well as putting yourself in the situation of receiving more verbal abuse/threats from  her.  It becomes a game to her.

4)  No matter what she tells you, she cannot control your immigration process.  She cannot get you deported.  She does not hold the keys to the USA.

5)  Keep going forward with divorce proceedings.  The fact that you initiated divorce proceedings is a good thing (and also a mark in your favor if you are worried about her "sham marriage" threats---foreigners who have married just for a green card normally do not initiate a divorce with their USC spouse before AOS).

6)  Continue with your therapist if you feel it he/she is helping you.   It is not a sign of weakness to seek help in your situation.

I had last contact with her in July last year when her friend asked me if I am willing to pay child support. Since then there was no communication from her side. She inform me about the birth of child almost after a month of giving birth and started sending me emotional emails and I did get manipulated and called her up because of the child. But, when I called she said I should be worried about myself because she will bring her contact person from immigration and there will be judge and I will be getting arrested.

 

I have asked for the DNA to contest paternity but the situation is if I can't ignore messages about the child. I don't know what to do. She told all her friends and family that I left her which is not true this is why I recorded our last conversation.

There are good legal reasons for this.  Trust and heed your lawyer.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
