Hello,

My husband has a green card lottery .He proposed me before he went in America. We got married before he left. At the moment he is in America and I’m in Macedonia. He is only one month there and he got his social number. He still doesn't work yet but he will start for a month.

Any advice how can I go to America and be together?

Why didn’t he add you to his lottery case? When did he win - if it was this fiscal year (dv2018], which it sounds like, he may still be able to add you as a follow-to-join to his case - dv will be the fastest, easiest  and cheapest way to do this if it’s still an option. I am assuming he updated his details before the interview so that the embassy knew he was married before he got the visa?

No one is going be able to sponsor you faster than a spouse (unless you already have an adult US citizen child who can do it).

He won the lottery 2017. We didn’t know about that way, which one is the easiest way (now We know but it's too late). He got his visa in December 13, 2017.
We got married in February this year. It was a week before he left Macedonia and went to America.
Now we don’t know which one is the right way to start the procedure.

When he won the lottery he must choose a sponsor and the sponsor is my cousin who already lives in America. Can my cousin be my sponsor , because if my husband is my sponsor it will take a lot of time because he must earn enough money. He will start to work in a mount.

I want to be with him as soon as it’s possible.

Cousin cannot be a sponsor.

Only your husband, and it takes ~2 years.

Just so you are clear, at this point, your husband is the only one who can petition you to bring you to the US as a green card holder to live with him. This process takes around two or more years. Your cousin can be a joint sponsor financially if your husband isn’t earning enough, but that will be required probably a year and half or more later after your husband files the petition for you.

In short, it will take around two or two and half years to immigrate to US as a spouse of a GC holder.

I don’t think so. FTJ is not an option for someone who processed CP with regards to DV lottery selectees. A DV based FTJ is an option for selectees processing AOS with derivatives processing CP.  It involves filing an I-824 following a successful adjudication of an AOS petition according to 9 FAM 502.6-4

https://fam.state.gov/fam/09FAM/09FAM050206.html

OP might have stood a little chance of benefiting as a DV derivative if the spouse hadn’t entered the US already with his immigrant visa. He would have had to contact the embassy directly to find out if his wife could be interviewed as his derivative.

So it is DV2018 (oct 2017-sep 2018]. As Sm1smom says it looks like you have missed out but I would actually suggest seeing as it’s long before the fiscal year is over, to contact the embassy and see if there is any way you can still be added to his case. It’s worth a try.

You didn’t answer a previous question - did he update his details so that the embassy knew he was married (even if you were not accompanying him) before he was issued the visa?

I think G&VM is also not clear on this.  To clarify for her: you can only be “sponsored” as in petitioned for a visa, by an immediate family relative (spouse, parent/child, sibling). So your husband is the only one who can petition for you. If he doesn’t have enough income for that, then your cousin can be a financial co-sponsor. But your cousin cannot petition for you.

Seconding what others have said.

As your husband, he should petition for you. This is not a speedy process - there's no way you can come here immediately, by taking proper channels. If your husband isn't making enough to meet the financial support requirements (I know you mentioned he isn't working yet but will be), he can have a co-sponsor to cover that part.

OP did answer this question.  He was issued the visa in Dec 2017.  They were married in Feb 2018.  It would have been impossible for the OP's husband to claim his wife on his visa BEFORE it was issued as he wasn't married for another 2 months.
