N400 3 year rule - Lawyer said not to send evidence?

Hi all!

Just filed my N400 this evening by mail through my attorney. The first filing date is next Monday so he will be sending off my package Friday. I am filing with a pending i-751. What was interesting is this, he advised to send none of the evidence they need except for just the vital information (green card copy, Selective service number). He advised that because the  i-751 hasn't been approved, there is no need to send new evidence and I should simply bring it to my interview whenever this may be. Thoughts on this? It seems like it doesn't quite follow the norm that I have read other applicants have done. I have to trust him as I expect he has done this a million times, but it put me on edge!

That is interesting advice from your lawyer.

Be prepared of the possibility in receiving a RFE for required documents, and keep all evidence you have gathered to bring to your interview as well.

Hmmm...Sounds counter productive.

 

I would ask the lawyer what could possibly hurt if you DID send it.

You already know the risk if you don't send it and they want it. RFE's and delaying your case.

You should fire that guy. First of all you should have filed on line instead of regular mail. Paper filers are taking a year or more to process. It took my N-400 10 months cause I had no clue you could do it on line. Second you should have had sent all the supporting document you have. Everybody knows this. That is why this web site it's so helpful. Our immigration journey started in 2011 and not a cent spent it on lawyers.

The N400 doesn’t ask for a lot of required documents.  We sent in Katya’s N400 with only what was asked for in the N400 intstructions (in her case, a copy of the GC front and back, and the marriage certificate).  We also had an I751 pending and for her interview we took additional evidence such as updated tax returns which we added to the I751 package.  We did not receive any RFEs for either the I751 or N400, and both were approved by the IO.

Sounds like OP's lawyer didn't even send in the marriage certificate though?

Not everyone likes the idea of filing online though...it's got it's pros and cons.

(I filed online from NY....speed of my process was a definite plus)

Thank you for all of your responses! My attorney took copies of the basic documents like marriage certificate, greencard copy etc. He just didn't provide the joint documents like utility bills, bank statements etc.

Oh yeah those things you can just bring to the interview----possibility of you getting an RFE for them really depends on the IO processing your application and how straightforward your case is...some people receive RFEs and some don't.

I recall reading about one case last month where the person filed in NJ based on 3 yr marriage rule, did not mail out supporting evidence of marriage, brought it all at the interview and the officer did not look at it at all but asked the person to go home and send everything by mail. The couple was very disappointed. That being said, I would say mail everything now and bring copies at the interview. You have nothing to lose but gain a peace of mind.

1. What date I have to put where it asks "date you became a permanent resident"? Date from old GC or new GC?

2. A copy of which green card I have to take, old or new?

I filed online in July and I filed paper in June. U were done within 3 months and I just finished my process last Friday. That's a huge difference there are people waiting for over a year just to have an interview schedule. I will strongly recommend to everyone to file on line!

Oh I recommend it too for the most part.  What I'm saying, though, is that it's got it's pros and cons for filing online as well.   Many people who filed online when it first rolled out got stuck in background checks for about 5 or 6 months---some had to involve their congress person to get their case moving.  One person I know of ended up withdrawing their online application because it was taking so long and paid a second fee to file the paper one which finally got him an interview date.  Thankfully it seems the online route has gotten most of the kinks out now and it seems to be picking up speed for most.

 

For the most part, I recommend filing online...the speed does mostly depend on the filing office though...and yes, NY is notoriously backlogged which was one of the reasons, after researching threads here and on another forum, that I decided to go with online.  Congrats on becoming a citizen!
