60 days after submtting RFE

Hi Guys,

 

I submitted my RFE in Feb 2018. I have not got any status update of my i-485 application for 60 days. 

I called USCIS and was told the USCIS local office in my area needs 5 to 15 months to process the marriage cases.

 

What shall I do? Waiting? If the RFE is not accepted, I have to do it again. It costs too much time.

Yup, wait. They will notify you if there are any updates to your case, or you can keep checking if you believe they did not contact you with an update. You can check the case status online, although that doesn't always update.

 

Was it an RFE or RFIE? When did you file for AOS? What was the RFE for? All of these can impact how long the process will take. The 5-15 months estimate sounds roughly reasonable.

 

If the RFE does not provide the requested information, they will either issue another RFE or deny the application. At which point you can appeal it, or refile AOS if you are still eligible to file at that time.

Hi Geowrian,

 

Thank you for your reply. RFE is for my Affidavit of Support(i-864). I applied my i-485 in Nov last year and response to the RFE by providing new evidence in Feb this year.

It has been 60days so far. So, if I have not got any updates, does it mean that there is no problem with my RFE?

It can be 60 days or 160 days. It doesn't mean there is a probably. The 60 days is simply a "guideline" on the usual processing times after RFE's. If it takes longer, then it will just take longer.

Thanks for the update. It sounds like a Request for Initial Evidence (RFIE) given that it was for the I-864.

 

Unless you hear otherwise, I would assume it's sitting on a desk awaiting review/processing until I hear otherwise. Even once they review it, it's not actionable in itself...they would still need to schedule an interview (mine's been in this status since Nov. 2017 as well), actually schedule the interview, and then there will be an interview (or it can possibly be waived for K-class applicants, in which case it's just waiting for approval). They won't notify you automatically if the RFE response is sufficient until they either schedule the interview or approve the case.

 

Edit: If you applied for AP or an EAD, you would also know the RFE was received and acceptable if they approve those forms (since they halt processing while the RFIE is outstanding).
