Hi everyone,

 

I have a question about the I-129F. I am in the US until the 12th of June with an ESTA. 

My fiancé an I are fulfilling the paperwork and we are struck about the question 38F in the "Beneficary Part" which is Travel document Number. I already indicate my I94 Record Number so I don't know what it could be. 

 

Moreover in an other forum, someone pointed out the fact that with an ESTA we can't send the paperwork while I am in the US. IS that true?

That is not true.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You absolutely can send the I-129F while the beneficiary is in the US. There's a couple questions  specific to this situation on the I-129F itself, mainly asking for their current I-94. If you don't have a separate travel document number, then that doesn't need to be provided.

It is perfectly fine to file the paperwork while you are in the US as a visitor. It just means that you have to answer question 38. You either provide a passport number or travel document number, depending on what you used to enter the US.

Thanks for your answer. So for me being in US with my esta I assume I don't have a document number.  it's supposed to be fine with just my passport info and I94, right?

Correct. You can write N/A in the space for travel document number. I believe that's what I did.
