Hi all,

 

I'm in need of help about my situation.. my case is rare but I hope i'll be able to get help from here. So I am single and never married but someone used my name and registered as married .. I only find out when my ex and I planned to get married in 2014, he never helped me fix it .. till we broke up .. then I met my fiancee,he knew about my situation and helped me fix it, our attorney advice us that annulment wont be applicable in my situation,coz I was never in a relationship with the guy I was married .. it needs to be CANCELLATION OF MARRIAGE .. my case was unfortunately the 2nd case happened here in the philippines,so it's very rare .. but I've got lots of evidence that I was never married .. so my  petition of cancellation of marriage granted in January this year .. our attorney told me earlier today that I won't be able to have a CENOMAR (CERTIFICATE OF NO MARRIAGE),I will only get a MARRIAGE ADVISORY, saying that the MARRIAGE is CANCELLED .. same with the MARRIAGE CERTIFICATE,it's annotated as CANCELLED ..

 

Now my question is, if we are going to file the k1/k2 visa, in i129f form, should my fiancee put me as single or married? My attorney told me we should declare that I am single because everything is already CANCELLED .. the only thing I won't be able to have is the CENOMAR.. PLS. Help 😢😢😢

8/16/17 --- AOS Packet received Chicago USCIS Day 0

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

" Have you tried the search tool? K1 isnt an easy process and a LOT of reading is required to avoid problems (RFEs) etc, if you dont like reading, be prepared to spend WAY more time and couple more $$$ with an lawyer "

The requirement for the I-129F and K-1 visa is that you are free to marry. While the Manila CO may ask for a CENOMAR, they really just want the CENOMAR or CEMAR and then evidence that any prior marriages are dissolved. I'm not familiar with the specifics of your circumstances, sorry, but if the paperwork shows that you were never actually married then this should suffice.

 

You should put on the I-129F is you are actually single or married at the time of filing. As a hint, you must be single at the time of filing to have a properly approved I-129F.

I have a CEMAR,and its annotated CANCELLED .. we are not sure what to put on the I129f 😢I am free to marry .. I have all the evidence that my said marriage was already CANCELLED .. should we put on i129f that I am single? Or should we put that I was married?

If you are free to marry, then you're single. The annotated CEMAR should suffice for the CO as well.

What SSN? It wasn't someone with the same name .. all the details was mine .. obviously,someone had all my details .. the only difference was the signature on the marriage certificate ..I don't have any signature in it ..

Are you single or married?    Taadaa!    Many single women can not obtain a CENOMAR, they are issued the CEMAR (Advisory of Marriage) instead.      At PSA you always request a CENOMAR, if married (or your case) then they issue the CEMAR

 

You are using an attorney but don't trust his advice?   hmm.

I'm single .. never married,but my CENOMAR says I am married .. we got it fixed .. I didn't say I Don't trust my attorney .. we just think that immigration attorney and attorney that work for annulment is different..
