Help! Am I not able to visit my family once I enter the us

Hello

 

does anyone know if during the probation period of getting a green card if we are allowed to visit our family at all? It just seems so unfair that when I will be the most stressed and home sick I won't be able to visit my family. That could be up to 18 months and probably the most doifcilt 18 months of my life. Any help is appreciated.

Assuming K1 then you need AP, 4 or 5 months after you file to adjust.

While sending documents for AOS you can apply for I-131 (and a work permit too) for free which is a travel document permit. If you visit your family in Canada before owning a GC this will let you re-enter states. It’s all described in AOS guide here in VJ.

My friend, dont get me wrong, but before coming to US, I assume that your desire was to stay with your spouse right? So, now you have her to support you and help you going through this difficult moment that everyone goes through. There is no shortcuts no other paths.

 

Unless you have your advance perole before receiving the GC, you cant leave US. Get used to it, enjoy your new life.

As others have said, once you marry and file Adjust of Status paperwork, it currently takes about 3-4 months to receive your Advance Parole document.  At that point, you can travel outside the US.

Maybe the fiancé visa isn’t the right path for you then if being able to travel

as soon as you get to the US is that important. 

 

A spousal visa takes a little longer on average but is cheaper in the long run and will allow you to travel as soon as you enter the us on the visa.

You can apply for EAD/AP but also need to be aware of the following.  Perhaps your spouse can apply for CR1/IR1 while you wait at home?

" No. This card authorizes parole, not admission, to the U.S. Parole is not an admission or "entry".  If you obtain this card, you may use it to travel abroad and return to the U.S.  Upon arriving at a port-of-entry, you should present the card to a Customs and Border Protection (CBP) Officer to request parole. Issuance of an Advance Parole document does not guarantee that CBP will parole you into the U.S. If parole is granted, you will be permitted to come into the U.S. as a parolee, but will not have been 'admitted". Individuals who have been unlawfully present in the U.S. and subsequently depart and seek re-entry through a grant of parole may be inadmissible and ineligible to adjust their status."

This, my husband and I don’t have any immediate family in the US. We have a regular time each week to skype home to various family members.

I hate to be so blunt, but don't do the crime if you can't pay the time. If the ability to visit your family abroad is important, then a K-1 was not the right path for you. This is something that really should have been figured out and decided before choosing the K-1 option. It's hard, but it's not really unfair....you (most likely) got to be together faster than those who married.

 

As others noted, when you file for AOS, you should also file for A. ETA: ~4 months. This allows you to leave the US and re-enter without abandoning your AOS application.

To be blunt, it is fair. It's a part of the process for a reason. It's also disclosed upfront when researching the K1 process (which I'm assuming you're referring to, as CR1 has different process) so people understand what they are getting into once embarking on this path.

 

Does it negate the frustration? No. But it's not unfair. It's part of the journey. You have to decide what are dealbreakers for you and your partner, and what you are willing to deal with and push through (which, in this case, is a temporary hurdle) in order to fulfill a life together. After all, that's what you are doing this for - to be with your partner and have a life in the US, which is not an immediate right to any and everyone but is a privilege available to all willing to do what's required to achieve it.

 

That being said - you can apply for Advanced Parole at the time you apply for Adjustment of Status. Typically takes up to 90 days to be approved and is usually received within 3 to 4 months - sometimes less - if approved. You can also apply for a work permit at the same time, which has a similar timeframe.

Good point. It's a matter of weighing the pros and cons among the different options. You have to decide which is more important - taking the path that may have a quicker/shorter timeframe and end result, but may have to wait longer on the other side to do things like travel abroad... OR taking the path that may have a longer timeframe and end result, where you will be able to do things like travel abroad right away once on the other side.. it just may take longer to GET to the other side.
