Hi everyone,

 

Forgive me if this is a old subject, but I just found this site and have a question.

 

My fiancee is in Ukraine and we are starting the K-1/2 process. The problem seems to be figuring out what paperwork is required, and by who, as far as her daughter being allowed to move to the US. Specifically from the ex husband.

 

I've called USCIS, they say they don't require anything. Called the US Embassy in Kiev, they say they don't require anything. I went to the Ukrainian Embassy in DC, they say they don't need anything.

 

I'm sure that this isn't the case and that something from her ex will be necessary for her to move here. He will not be cooperative, which creates a big problem if we need a letter with his approval.

 

I did read about a letter that is required on a forum somewhere, but I'd like to find out from someone with experience exactly what is required and who will be asking for it.

 

I really appreciate any info or feedback.

Hi! I am surprised they said they don't require anything. If the court decision in her divorce decree doesn't specify that she has the sole custody, she needs to get a letter from the notary signed by the biological father  that he allows his child to immigrate to the states. Maybe the law changed. I doubt though. The child won't be allowed even to cross the border because at the passport control they require a permission to travel outside of country (the airlines even check that at the check in desk). I have to go to notary to the closest consulate to get the letter that allows my child to travel back to me when i send him to visit his father to Ukraine so that they would allow him to leave Ukraine. Usually both parents permission is required. Last time it was this past winter.

Okay, here is I found more. I can tell you that embassies are not helpful when you call them and ask for information. Most of the time they  won't tell you what to do and what documents you need. It can be seen clearly even from the answer here below. its like they are withholding the information. Why? I have no clue. I only assume they follow a particular procedure and that is how they operate.

Q.8 I am applying for a K1/K2 visa. I have temporary permission from the child's father for a trip to the United States. Is it a valid enough document to be provided to the consulate?

We can not assess the validity of documents in advance. During the interview the consular officer will review your documents and tell you if they are enough. You must be prepared to verify the right to bring the child abroad and to provide relevant documents. Government of Ukraine has certain requirements for taking children abroad. Please refer to the government of Ukraine regarding requirements for documents for taking a child abroad in your particular situation.

That's what I figured. I knew this process would be filled with people that don't know anything until it's time to reject paperwork. I was surprised that the consul at the Ukrainian Embassy didn't have more information.

 

The link you attached is more info than I've found yet and I really appreciate it!  We'll get moving and hope for the best and that it goes fast!

That's awesome Lenchick, thanks so much for the links. I might not have ever found that!

 

And not one person that I talked to had a clue, even when I mentioned that they are the ones that establish these requirements.
