Hello everyone.

 

I have a couple questions. I'm currently waiting for my NOA2 to be approved. I have a immigration lawyer who is helping me along the way but is no help some what because every question that I have and try to ask never seems to get answered and I will end up having to find else where.

 

I have meet my fiancee Chau back in February 2017. After couple months of talking back and forth we decided to form a relationship and I visited her in January 2018 along with my mother. I have told my mother that I was about to propose to her and so she came along to with me to make sure that she was the right one for me. My mother approved and we ended up getting engaged and had a engagement ceremony. I will be attending her interview with her once we are at that stage.

 

Now my question is during the interview will I get to attend the interview or will I have to wait outside of the consulate. If not will I need some form of paperwork to enter the consulate? Also how long does the medical exam results take? After approval of the interview how long does it take for her to get her visa and how quick will I be able to make plans on her coming to the US. I will be returning to the US with her. So wondering if I should purchase a one way ticket to Vietnam and once we have a specific return date to purchase another ticket back along with hers or if I should just purchase a round trip ticket. Any information would be greatly appreciated.

Figured I'd go a head and see if can give you a little bit of info.

 

Perhaps your lawyer is hesitant to answer specific timeline questions because, honestly he can't same as no one can entirely, maybe give 1-2 week window; but nothing is set as specifically 3-4 days or what not.

Medical exams results can be given same day or, depending on the process of the country, may take 1-2 weeks for the embassy to receive the medical information. 

 

As to how long to get the visa in hand if approved.... this can vary dramatically. Some can be 1-2 weeks afterwards. Some can take months. Also are they possibly going to ask for some other documents that got overlooked or forgotten? Possible and this can add to the delay. So the timeline is hard to say. Also you have to, even after approval, go through administrative processing or AP.. Everyone goes through this stage, some last 2-3 days, some 2-3 weeks, some 2-3 months, and some even 1+ years. Can vary on different issues like background checks, security stuff, maybe verifying information and such.

 

As to the tickets, that's up to you. If you can go spend a month or something over there then by all means go take the time and be there. If not, then it's totally up to you, I won't try to advise on this myself personally.

You can find information on this link,

 

1st once you get your NOA2 it will go to NVC which takes about 3 weeks to get your HCM case number

 

Once you get the HCM case you can start filling out the ds 160 and pay the visa fee

 

After that you can schedule your medical exam and pay the medical exam fees

 

You can be there when she goes to the interview you may be called up to the window to answer questions from the officer.

 

After she passes the interview she will give them her passport and issue the visa which takes about 7-10 days to receive. Once her VN passport with visa is issued and returned I would then schedule your flight back to the states with her.

Ditto to all the advice everyone's already given :)

 

I also wanted to add - I was visiting my fiancé in Sweden at the time he had his interview. We weren't sure about my attendance, either; for K1, it isn't required for you to attend, but I wanted to for support. I was able to wait outside in line with him, but when it came time to go through the security booth and continue inside, I wasn't allowed further. I had to take a cab back to our hotel and wait there. The security officer was very nice and said something about a list, though, which peaked our interest. Not sure if there was a "visitors list" we could've called ahead and had me placed on or not.

 

That being said - I've heard of people in other countries being able to go inside with the beneficiary with no problem, so it definitely varies by country/embassy. When the time comes, I suggest contacting the local embassy where the interview will take place for clarification. That way, if there is a required visitors list, you can add yourself if you wish to go with your fiancé.

You can go to the U.S. consulate for her interview b/c you are an American citizen. Just bring your passport. I'm glad I went to the interview b/c they asked me questions after they were done with her. You could book your return flight and her one-way (on the same plane) two or three weeks after the interview date - the longer you can wait, the better. My fiance received her passport (stamped with her visa) in about 8 days. Some take longer. And you might get delayed if they want more info before issuing the visa. Make sure you have EVERYTHING (copies of originals, etc.) when you go to the interview. I had all of my tax/income info, divorce decree, etc. I'm glad I did. Expect to be at the consulate for several hours. Also, get there early - 7:15 a.m. at the latest. While waiting outside, don't talk to anyone. There are a lot of scammers hanging around the consulate. Talk to nobody. Good luck!
