I-864 Joint Sponsor

I'm filling out the I-864 for my husband but I have no income (I was a student and then worked briefly abroad) so we're using my father as a joint sponsor and he'll be filling out I-864A for us. Here's my question: My parents file taxes jointly but my mom is a housewife and has no income so all of the income on the tax return transcript is my father's. I've heard that may be a problem because the NVC wants to make sure his income alone is sufficient and we'd have to send in W-2s to prove that. However, he's self-employed and so he can't provide us with W-2s. Does anyone know what we would do in this case?

The USCIS actually has a few guidelines when it comes to proving an income amount for a sponsor that is self-employed or a business owner. The USCIS suggests that self-employed sponsors should attach the following photocopies of documents to their I-864, Affidavit of Support:

  • Total and Complete Tax Return: All schedules associated with the federal return including Schedule C (Profit/Loss from Business), Schedule D (Capital Gains/Loss), Schedule E (Supplemental Income/Loss) and Schedule F (Profit/Loss from Farming).
  • Business Licenses and registrations.
  • Signed and dated statement about the nature of the business and the sponsors involvement.
  • Bank Statements for the previous 6 months

Thank you! I guess I'm just a little confused because of the joint taxes. I can't use the tax return transcript instead  of the tax return?  And I had read somewhere that you could attach the 1099 instead of the W2 to prove individual income.

Unless you are listed as a dependent on your parents tax returns, you will still complete your own I864, even th ouch you have zero income. As joint sponsor, your father will complete his own I864 and ypur mother an I864a attachment to his I864

If you are a tax dependant, then your father will complete an I864a to accompany your I864

Even IF she is a dependent, the father will not use an I-864a.  That form is for combining income OR for a joint filing spouse.  I-864 from petitioner and joint sponsor, then I-864a from joint filing spouse of joint sponsor, whether she has any income or not.  This is because it's a contract and both sponsor and spouse are obligated under that contract.

My father is going to be a joint sponsor for my husband. I know I have to fill out the I-864 but I'm confused as to what my father should fill out. I'm still listed as a dependent on his taxes but I don't live with him anymore. Does this mean he also fills out the I-864 or does he need to fill out I-864a? I know this is online but I'm just reading conflicting things! Thank you so much for the help.
