I am a Filipino citizen residing in US as a legal resident. I plan to marry in the Philippines with my fiancee at the end of the year. My US Citizenship is in process (waiting for the interview) and I am expecting to be a US Citizen before our marriage. One of the requirements to get a marriage license in the Philippines if you are a foreigner is you need to have an Affidavit in Lieu of a Certificate of Legal Capacity to Marry. I could get this in the same day, but the marriage license would take us 10 working days before we can get wed. The wedding is in December 21st and I already booked a ticket on the 17th without any idea that this was a requirement, so basically we do not have time to wait for 10 days for the marriage license if ever I become a US citizen before we get married. 

One of our plans is to get a marriage license as a Filipino citizen, and eventually be recorded as a Filipino citizen on our marriage contract whether I become am a US Citizen in the process or not.

My question is: what will happen if I get married as a Filipino citizen in the Philippines and eventually become a US Citizen in the process? Are we going to have problems on filing the petition if we decided to live together here in the United States in the future?

As a US citizen, you will petition your spouse for a CR-1 spousal visa. For the US citizen, it is not a problem. Just make sure you both are legally free to marry.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Does Phil allow you to hold both Phil & US citizenship simultaneously? 

 

You can get married, petition spouse for an F2a visa, and upgrade to CR1 as a USC.
