My fianceé's mother was visiting USA on a tourist visa last year. She happened to meet and marry a US citizen a week before her tourist visa expired.  However, (six months later) they have yet to file for an adjustment of status, but they are slowly preparing to file paperwork soon.  So, I am wondering if my fianceé's mother's status is technically illegal or not?  Could her mother potentially be deported?  Will she have any problems with her adjustment of status being filed 7 months after her marriage to a US citizen?  The main reason I am asking these questions is my fianceé is very worried her mother's (limbo) status could cause our K1 visa to be denied.  Our application is at the embassy (status: ready), and she has completed the online DS-160.  My fianceé is thinking we should wait for her mother to get her status completely legal before we attend our interview.  Anyone have specfic information or advice about this situation? Thanks!

1& 2.  She is here illegally. Any time between the time her I-94 expired and the time she files for AOS, she is subject to being picked up by ICE.

3.  I'm sure she will be questioned about it.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
