Hi guys,

 

I'm under F1 visa, doing OPT, married to my USC wife and we're filing the AOS package.

 

In I-864...

As I'm under my engineer OPT and the main income of the house, since my wife just graduated and still looking for job (0$ anual income), we'll be filing with "Income you are using from any other person who was counted in your household size, including the intending immigrant". Is this correct ?

 

And when signing this document as "Sponsor's signature", who should be signing this? My wife as the petitioner, or me the F1-visa as beneficiary.

You cannot self sponsor your AoS. No matter the income, your wife will be your primary sponsor. Not sure on this, but I think you might need a co sponsor.

Thanks for your response. However I do not believe so. As follow with the below information, I have obtain a proof of employment from my company, and a paystub of 3 months.

This is from the newest I-864 instruction

2. If you included the income of the intending immigrant who is your spouse (he or she would be counted in Part 5., Item Number 1.), you must provide evidence that his/her income will continue from the current source after obtaining lawful permanent resident status. He or she does not need to complete Form I-864A unless he or she has accompanying children

Your USC spouse will be the sponsor regardless and will sign the i864 form. Your income can be added to her i864 for total annual income only if, apart from the pay stubs and letter of employment, you get a statement from your employer that you will be working for the company and be earning at least the same amount after you get GC.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Hello Arken,

 

Thanks for clearing my concern about self-sponsor.

 

May I ask for the statement, should it be from my direct manager/director, or should it be from the HR ?

I don’t think they care as long as it’s on company letterhead.
