This girls family is very poor. I seen her moms place and were she lives. In almost an entire year she has asked me for NOTHING. And when i was with her on that visit she did not ask for nothing. Only showed me integrity and loving kindness and used her own money when appropriate. 

Im simply posting to find a way to see her more. Some of you ppl are after nothing but negetive outcomes and hoping to see ppl fail. You should be ashamed of yourselves seriously. You have no idea who i am and who this girl is but yet i get posts like this. Un believable and we wonder why the system is broke.

Nothing personal. No strong ties to the country, have immigrant intent, no B visa. Got the visa but can't prove it to CBP, denied entry. I suggest you read the tourist visa section here on VJ and learn more about it. There's no sugar coating in VJ. People are just truthful here. Good luck!

Ever since your first reply to me you havent been very nice actually and for you to throw a side ways dig at me to "good luck getting her a B visa" is insanely childish so maybe kindly just exit the thread and leave me be to figure out how best to approach my situation. 

Try being a little more professional and maybe your advice will carry some wait. 

Visa or not i dont fail my friend i only learn and move on ok. So have a grwat day for yourself.

Maybe I can help you better understand the situation you are facing with getting a Visa for your Fiancee.    At one point I thought it would be a good idea to bring my then girl friend (now Fianceé) to visit the USA.   My thinking is it would give her an opportunity to see how she would like to live here.  Unfortunately, like you, my Fianceé is also from a poor family and lives in a south east asian country.  After looking at the possibility of a B Visa, is became clear for her that attempting to do so would be a waste of my money and time.    The reason why is not my fault, your fault, or either of our Fiancées faults.   It is the fault of visa holders before you and me that violated their promise to follow the conditions placed on the Visa that was granted to them.   In 2016, the DHS reported nearly 700,000 Visa overstays, many who are still probably in the US now.   These are the people you should be angry with, not the members of Visa Journey.   The members here are only the messenger to you.    Some will say.... Don't shoot the messenger?

 

You and I are are both unfortunate that our Fiancées are from third world countries whose citizens have abused the US Immigration System.  That does not mean your Fianceé has intent to do so, or that mine does, but it has made things more difficult for you and me.   I have spoken with member here that have been able to allow their fiances  to stay in the US while waiting out the K1 processing, but they are likely from Western 1st world countries.   But you and I can not.   You and I are in the same boat.   To try to prevent overstays, the Department of State will need to see that she has very strong reason to return back to her home before her Tourist Visa expires.  Unfortunately, as much as you and she may think she does, the Department of State is very unlikely to agree.   Why?  Because of her brothers, sisters, cousins, (I am being figurative here, but I hope you understand) have shown a pattern to disregard the conditions placed on their VIsas.   I am personally aware with a Vietnamese woman currently in the US.  She entered on a Student Visa and was due  to go home 5 years ago.  For all I know, I believe she is still in the US.   You need to be angry with her, because she ruined it for you and me.  Sorry, but it is the truth.

 

And the Department of State has responded by tightening their scrutiny of our cases.   You can certainly try to get a B Visa for your Fianceé, just prepare yourself for disappointment.   Unless she owns property, a business, has significant assets, to show she has a very strong and obvious reason to return to Vietnam, she will probably be denied.   

 

Similar challenges exist with processing your K1.  Once you get to the embassy stage, the Embassy is going to be looking very carefully to see that you have a real relationship.   You know you do, and your Fianceé knows, but the Department of State needs strong proof.  Why, again because of your Fianceés "brothers and sisters" that lied to the Department of State and messed it up for you and me.    Yes, it is not fair, but the Department of State does not care.   

 

But, since you truely love your Fiancée, you and she will invest the time and energy to find a legal way to marry  (Note, investigate the possibility of a CR1 Wife visa, it will not get her here any sooner, but she get the green card sooner and scrutiny of the adjudicator may be less).   It has not been easy for me, and it will not be easy for you.   I know it is not fair.    I have collected 5 years of evidence, visiting my fianceé 7 times, and living with her in Bangkok for a cumulative total of over 14 months.   I feel pretty confident that there is no doubt that the Embassy will recognize she and me as a legitimate couple.  I am hopeful anyway.

 

But because of those before us that lied to the United States, the government is not going to give us the benefit of any doubt.  :(

Can you believe this. Reread the the sideways dig. One phrase. One dig. Yes ive asked 2 times to have the thread closed before this gentleman exposed his true nature. Its clear what the agenda is with this poster. 

Now hes trying to call on the mods to draw attention away from the "good luck getting the B visa comment" 

 

Why not just say " hey goodluck i hope you never see her again as long as im right and your wrong"  

Im trying to find the best solution to my situation here.

Do you have another solution? More time? More visits? Wasnt that the idea to have her visit me? Im listening to all of you.. more facetime...i cannot leave my job again for an extended time until janurary 1. 

She can travel, shes not tied to a great job at the moment and maybe in between jobs while helping mom. 

 As a matter of fact her mom does dishes on the ground under a spiggot. I ask any of you to find a woman in America that will be cool with doing dishes on the ground under a spiggot just sayin.

Joel thank you for the thought out response rather then the former. Very professional. I will talk with Her and weigh out options. We are both adults and im sure will find the right path.

You do not make it sound like she is somebody who could comfortably afford to vacation in the US.

I would give her the same hospitality that she showed me when i entered her land to see her if she was to visit...and then some. To repay her for her patience and kindness.

No problem.   Just a couple of thoughts about the services of a lawyer and and if you require one.   There is a good possibility that you can do a better job than a lawyer can.

 

1) A lawyer has no additional sway over the USCIS and Department of State than you and I.  So, in either case, the final result will be the same.

2) Filing the I-129F is actually not very difficult if you take your time and review the instructions.   (In an earlier post I pointed you to them, and the USCIS filing tips).   Before deciding to hire an attorney, review the instructions and decide if you can do it yourself.   In my case it was pretty easy because 

a) I have not filed for a K1 before

b) I have never been married before

c) I have no criminal history

d) my fianceé has not been married before

e) she has no criminal history

If you are in the same boat, that eliminates 50% of the work in filing.

3) Some lawyers have proven to be sloppy and have created more problems then they have solved.  If you do decide to use one, find one that specializes in K1s and is familiar with current processing.   Ask them how long it takes.  If they say 4 months, they have not done one in awhile.  8 months seems to be the going time frame.

4) Save the money and when you are able, go back to visit your Fianceé.   I have been flying from SFO to Bangkok for under $600 round trip.  But I am lucky I live close to SFO.  I realize that for it may be much more expensive if you do not have the luxury of living near a Hub Airport.   But getting a second visit in will likely be much more beneficial than a lawyer.

Another suggestion that I alluded to in the last reply is to consider a CR1 visa.   This Visa is necessary for petitioners you have married abroad and wish to bring their wives to live in the US.   Many K1 filers debate if the CR1 route would have been easier.   It is less expensive because the approximately $1400 for AOS is not required as the Green Card is given when entering the US the first time.  The down side is it takes longer to have the Visa issued.   So, think about skipping the lawyer and go back to Vietnam and get married and apply for a CR1.

And one more hurdle to be aware of (since I don't think it has been mentioned) and is not spelled out in the I-129F instructions.   During the Embassy stage, it is necessary to demonstrate that you have the financial resources to support her.    The metric used is that your yearly earnings are 125% above the poverty guidelines.   Assets may also be used or combined with earnings at most Embassies.   Liquid assets held need to be 5X the poverty guideline.    Tax Returns, W2s, and Letters of Bank Deposit are the vehicles to prove you meet the requirement.

 

This is required because the US government needs to ensure that your fianceé will not become a charge on the services it provides to its citizens.

 

It sounds like this will not be an issue for you, but it is something to be aware of.
