I am applying a visa for my mom to come to USA. I am the sponsor so I filled out the I-864 form. My husband is asked to fill out the I-864A form because he is considered my household. 

 

 In I-864A form Part 4, 1a. "Have you filed a Federal income tax return for each of the three most recent tax years?" and ask to provide each of most recent year total income. 
 
Should my husband answer YES or NO to this question? He was not required to file 2015 income tax because he was not in USA and did not have a social security number at that time. However, he did file the 2016 and 2017 income tax with me. He came to USA in 2016.    
 
Would you please give me some advices to this question?  Thanks!

Two things.

 

He only needs to complete the I-864A if you are using his income to meet the requirements. If you make enough yourself, his I-864A will not be required as you can sponsor alone.

 

Was your husband a USC in 2015? Doesn't matter where in the world he was living, he was still required to file a tax return as a USC unless he was earning so little he was below the threshold. If he wasn't a USC or was earning below the threshold he just needs to provide a statement to attach to the I-864 to explain that.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
