Prudent to carry all relevant docs to the interview, but they should be prepared that none may be looked at.

Hey everyone, I have another quick question that pertains to this situation but I didn't want to make another thread for it. So an issue that arose for the in laws is that the 9 year old son that they're plan on bringing with them has a mistake or typo in his passport. Instead of his last names first letter beginning with a "K" like his parents passports do, they wrote a "Q" in place of the "K", the name still sounds the name when pronounced but it just doesn't match whats in his parents passport.

Does anyone know if this will be in issue at the interview or if they will deny it just on this mistake? I asked them if they can get it fixed and get a proper passport but they said it might take a month or longer and would mess with their plans.

So his passport does not match his birth certificate or his parents names?

I believe that only the passport last name does not match with his parents passport, but the thing that they consider a birth certificate there is written in the local language so I'm not sure if that even would apply to this scenario? Its really complicated in that country when it comes to such things

So my father in law is going to get the birth certificate translated and it should show that the name starts with a "K", so would that help them?

can anyone chime in?

The transliterated spelling isn’t that important , the embassy probably sees this kind of thing regularly, what is important is that the birth certificate properly lists the parents. The embassy needs to know that they are issuing a visa to accompany genuine parents.

Usually local language documents are ok to use at the embassy of the country they are issued in except a handful of countries, so the fact that the documents are in original language shouldn’t be a problem.  If you want to be extra cautious or you know you need English documents at your embassy then translate.

Well he got the birth certificates translated for each of them to english and yes it shows that they are the parents for the child but I just hope in the interview they don't face any problems because of the spelling error in the passport of the child. Also, if for some miraculous reason they do pass the interview and get the visas without issue for all of them, would they have a problem with the spelling error in the child's passport once they reach the US port of entry?

The general rule is that you should not travel with a passport that has an error in the biographic data.i don’t know if it will cause problems at the border - it may or may not though I’d think the thinking would be it’s ok if they got scrutiny before the visas . However, I think there’s a reasonable  chance it will be an issue for later visas/travel when the same person has traveled under different spellings.

Prior to reaching any US port of entry, they'd have to get past Afghan border control/security, who aren't the most friendliest lot.

That's all assuming they get any visa.

How long does it take to get a new passport with the corrected spelling? As others have said, the visa should not be the major issue as the COs are familiar with local documentation. If visas are granted (they do seem to have a solid case from what you wrote here) perhaps they can request a letter explaining the spelling discrepancy. But, yeah, new passport would be best.

Hey, thanks for all the replies everyone. So I'm back with an update on the whole situation and didnt want to make another thread for it. I'm really ticked off because this whole scenario seems like a scam perpetuated by the embassy to get money from individuals with nothing in return. Here's why I'm ticked off and think that way, I'll try to be as brief as possible since this situation made no sense. So my in laws went ahead and changed their son's passport to the correct spelling, and had gone to the interview a few days ago. They made sure to bring all the correct documents with them including proof of country ties to show that they are not intending immigrants since that is the biggest reason they hand out denials. The documents they had as proof were bank statements, home deeds, and business deeds etc. While at the interview the consular officer asked them a few questions such as their names, where they are going, and who they are visiting plus DOB's for their family that they are visiting.

The whole interview only lasted about 5 minutes, but throughout this time the consular officer never asked them to provide any documents to prove ties to the country and that they are not intending immigrants, and my father in law was confused as he was ready to hand the documents to the officer. The officer then handed them a yellow slip saying that the case has gone into administrative processing and that they need to submit a document which I can assume from the handwriting says "ns-5535" which yielded no results when I googled it, so we dont even know what it had asked for. Later on in the day after the interview they had received an email from the embassy that said that in order for the case to continue they would need to fill out the document attached which was named NIV biodata questionnaire. The questionnaire had about 10 questions which asked about their family and living history for the past 25 years, so I helped them fill it out. Now this is the second part where it gets really frustrating, after the document was filled out, they emailed the document to the embassy as it had said so in the email. Then exactly 20 minutes later they get an email back from embassy saying that the case was denied because they had not proven that they would not be intending immigrants. I have no idea how they were able to review that document and issue an answer within 20 minutes, it makes no sense.

I've attached a picture of the yellow slip they had gotten to see if perhaps one of you can tell what document it was requesting from them, because as I said their situation made no sense since they were treated really unfairly. Has anyone been through this situation, if so, do you know how this can be reversed without having to redo the whole application all over. Thanks in advance.

A quick perusal of this forum would have told you that it is very rare for documents to be asked for.

Also you may see posts offering all sorts of forged documents pop up on this site, if only for a short time before our wonderful Mods delete them.

As an aside many of us have those documents and live in the US.

The additional biographic data seems to be normal from high risk Consulates but seems somebody screwed up asking for it when it was not needed.

So then how exactly can applicant prove they are not intending immigrants if they do not take any proof, that makes no sense. I understand forge documents might be an issue in this type of situation but my in laws had legitimate documents. Also why do they ask for applicants to show that they have strong ties to their country when they dont even look at the supporting documents they present? This boggles my mind to think that they can do stuff like this.

The form says DS-5535, which is the additional questionnaire they emailed to you.

It's quite common for a CO to not ask for/look at any documents during the interview.  That possibility was also mentioned earlier in this thread.
