Hi I am just wondering.. I have read the guide on how to remove conditions and file for I751, but I am just confirming that the only things they need is the I751 form and evidence? The financial stuff like forms from the sponsor and the form asking about spouse's income, that we used in adjusting status is not required? I'm the U.S. citizen and thinking about going from working from full time to part time and also going back to school, so I just want to make sure I don't have to be making enough money in this time. TIA

You are removing conditions on an already issued green card.  You are NOT applying for new status.  Affidavit not required

No income requirement to have your conditions removed. Financial records showing couple's joint ownership of assets and responsibilities is needed, such as joint bank statements, joint tax returns, joint lease, and joint utility bills etc.

I have a question regarding Removal of conditions as well, I did not want to start a new thread since it is pretty basic.

Im about to file my i751 this month, im just going to assume we will get an RFE since im limited on evidence, 

Are you allowed to send in evidence from the time you file to the time you receive a RFE? or will they be asking for evidence before you filed? We just see this window of time as an opportunity to gather more evidence while we wait for a response.

sometimes they don't send an RFE, they call you for an interview

 

 


Sorry I dont think I worded my question properly.

We are sending the evidence we have now,

but what im trying to say is while we wait for a decision (which takes on average a year), can we use this time to save up more evidence in case we get a RFE and send that in?

The ROC 90 day window opens in a week, I dont know what else we can possibly get in that short time period.

What we have is

Joint car ownership
Joint car insurance
Active joint checking account, years of transaction history
Photos from various family vacations
Were on the same phone plan with the family
Spouse discount cards from grocery stores
Driver licenses showing the same address

That is all, we dont have a rent lease in our name, the in laws are leasing for us.

what about health insurance, are you under your spouse's plan?

 

credit cards, life insurance, affidavits of 3rd persons (even if this is weak evidence, it is some evidence)

 

you didn't mention your taxes, you should be filing joint taxes. Have you done 2017 taxes? send all 3 years of taxes

 

a letter from your in laws, actually saying that even if the lease is in their name, your both are the ones living at that address

 

anything else that you can think of

we are still pretty young. my wife is under her mothers plan, I dont have health insurance through my job yet.

we never filed taxes as we didnt really make enough money, we were being supported during the whole process through our families, I only recently found a job a few months ago.

we dont have joint credit cards, thats why I was asking if it would be a great idea to get a joint credit card while the application is processing, in case we get a RFE

Do all letters have to be notarized?

Did you go to the dentist in the past 2 years, especially if you use the same dentist as your wife. I would suggest you file taxes anyways (too late now, but for anyone else who may see this). I had to file 5 years of back taxes (no income, was student. so taxes showed 0) when we went for the K1 and my father was the sponsor.

 

Or something from her doctor showing you are her emergency contact/able to receive medical information for her.

 

Are you guys not on the lease at all as the people living there? Or your landlord gives you a letter saying you both live together there?

 

We had all our letters notarized, but we also hired an attorney. We filed WAYYY past the deadline, so paranoia of being rejected set in, and paying an attorney was an expensive piece of mind. Good news though, we got approved last week! :)

I actually went to the family dentist last year, but she hasnt seen him since childhood but the dentist knows the whole family very well.

We are not on the lease at all, her mothers name is on the lease.

A quick letter from the family dentist attesting to your relationship might be a bonus? He has known your wife since childhood and knows her whole family and you are now his patient too.

Im just wondering if we ever do get a RFE and we have nothing more to send, what will happen? Do they request an interview?

With my attorney, he wanted at least 2 of them notarized. I did send some without notarization along with 2 that were notarized. The ones my parents wrote were the notarized ones. The other ones included contact info and invited contact from the UCIS if they needed more information. (Like my office number is xxx-xxx-xxxx, please contact me if you need further information). I had my dad, my stepmother, our dentist (husband is english so bad teeth and had lots of work done when he got here LOL) and a paid employee at our local Boy Scouts office  write letters attesting to our relationship.

If they ask for an RFE they just want more information that you have a valid marriage. If they request an interview, I am guessing it means you don't have enough paperwork to show them that and they want to see for themselves. If you have a valid marriage, you really have nothing to worry about. If for some odd reason you get rejected, then you get the attorney and push it through the second time on appeal.

 

We didn't send pictures, but we had a lot of other evidence, including a child, house, 2 cars, joint accounts, health insurance etc. The attorney was because we were obscenely late with filing for the removal of conditions.
