Incorrect resident since date

SMH, when will they get their act together? My husband was so shocked that there is no faster or easier way to fix this. Yes we filed an I-90 by paper and sent the card back. It was delivered to the Phoenix office last Friday, so no real updates yet. I expect we will receive the receipt notice tomorrow or sometime next week. How bout you?

Hello, I had the same problem. I had my residency from July 29th, 2016 instead of April 27th, 2017 when I actually recieved my greencard. They told me to file for I90, which I did online and this got denied. Now they're asking me to file I-290B, which is $700, for an error which is not my own. The letter also stated I didn't send my I751, when I did this 3 times. I called the USCIS website and got told by a Tier 2 officer I shouldn't have to pay, it's not my fault. I then got an e-mail saying if I want to sort it out I have to pay.

 

Yesterday, I went to my local congressman in the hopes their Immigration team can help me out.

 

Has anyone filed the I290B when it is not your fault?? I don't want to overpass the 30 days, god knows what they will do. How can they not have record of me sending my documents when they have sent me letters?

Wow, this is insane! I’m so sorry you’re having to go through all of this BS. Also, why the heck do they need your I-751? That makes no sense in your case. Here’s the thing tho, you can’t file I-90 online if you need a fee waiver which you do because it’s their mistake, not yours. That’s probably why you got denied. Also, did you send them the original green card that you need to get replaced? If you didn’t, that could be another reason they denied your application.

 

You’re doing the right thing by contacting your senator! However, I wouldn’t even bother filing I-290B because most of the time, they won’t admit they made a mistake. I would just file I-90 all over again and this time make sure you do it by paper with the original green card included. After you file, go ahead and call USCIS and request them to expedite your application because they made this mistake, not you. Also, include a note with your application saying that you’re requesting them to expedite your application since again that’s their mistake. After you’re done with filing I-90, that’s when I’d contact the senator. I feel like you can get it done a lot faster this way. 

 

By the way, I’m not a lawyer in any way so I’m just giving my opinion, it’s not a

professinal opinion, it’s just what I know from doing tons of research. 

 

I hope everything works out for you in the end! They really need to get they sh** together.

I sent a service request saying that my card has a typographical error. I want to see what they say. After looking more into it tho, I realized I might just have to end up submitting I-90. I will try to send get them to expedite it but I don’t know if they will. Fingers crossed!

Thank you so much for your reply. So shall I send evidence of their fault on the greencard from that letter they sent and also my attempts at filing the i751? How do they not keep track of documents sent to us? Its crazy. I’m scared of sending my greencard then I have no evidence of my residency except the i551 stamp I have. I think this maybe my next step after the congress involvement.

I think an I-90 is really the only way. I'm not sure why they do it this way when it's literally just a plastic card. It should really just take one phone call or an email or something.🙄 No receipt notice yet, no email or text notifications either. I tried calling the hotline but they said no case number has been assigned to my I-90 yet. So more waiting.

Oh my god!!!!! I'm so sorry they're doing this. They really need to get their sh*t together!!! I would not file the I290B because the card's mistake was their mistake. If your I-485 was approved on April 2017, then your I-751 should not be filed until 2019. So you still have time. I would not attempt to file I-751 again. It's not the right time for you to do that. The I-551 stamp is exactly the same as the green card so don't worry about not having the card.

Oh my god!!!!! I'm so sorry they're doing this. They really need to get their sh*t together!!! I would not file the I290B because the card's mistake was their mistake. If your I-485 was approved on April 2017, then your I-751 should not be filed until 2019. So you still have time. I would not attempt to file I-751 again. It's not the right time for you to do that. The I-551 stamp is exactly the same as the green card so don't worry about not having the card.

Yes I did it online, I suppose I should have sent this now as this letter shows their mistake. I just thought it would be easier to do it online. Do you think I should re-send this even though this initial letter was sent 4 months ago. I sent the online i90 15th of July.

Hmm it's kinda hard for me to say what the best course of action is. Do you have an immigration attorney you could talk to?? A lot of them do free consultations. Might be a good idea to at least chat with 2 or 3. However, I also do think it might be okay to re-file the I-90 by paper this time with a letter of explanation plus a copy of the letter admitting the mistake, copy of your approval notice for conditional residency showing the proper dates, etc. Also, make an Infopass and bring all this stuff and don't leave until someone helps you. They should at least give you the I-551 stamp or make a note in their system to bring attention to your case. Smh they suck.

The thing is, my initial i90 application was ‘approved’ as i went to biometrics, you would’ve thought they would have asked for the physical greencard then if it was a problem & also the fee was waived online too. Everything is confusing but thank you so much for your help!

Hm if you file online, they are supposed to send an RFE to ask for the actual card. But it sounds like they didn't in your case and further complicated the process. I would definitely speak to a lawyer and keep following up with your congressperson. I would suggest contacting the ombudsman too. Having more people on your side will help. Let's keep each other updated!

It looks like the left hand doesn't know what the right hand is doing. On the one hand, one department caught your residency error and updated it on their end, but when you followed their instructions to get your card amended, the other department that handles I-90s somehow cannot see the change made to your date and thus rejected it. I think you should send both of those letters to your congressman and explain exactly what is going on. USCIS seems to at least partially think you're out of status and that would not be a good thing...

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I am currently in the process of sorting this out with my congressman’s immigration aide. They contacted pontomac on 1st of November, I emailed today for updates as a follow up and nothing has been updated since on USCIS’ end.

For anyone who is curious and would like to keep track of I-90 cases: I just received a text with my I-90 case number (11 days after package was delivered to USCIS' Phoenix location). Paper notice will arrive probably by the end of the week or early next week. Phew! Now that I have the case number, I feel very relieved.
