Hi all,

I dont know the diference between CR1 and IR1. Is the same process? What are the positive point between their? What must I choose?

First phase:

07/20/2006 I Married with my soulmate

I-130

11/08/2006 We sent I-130

11/10/2006 Nebraska received and sent it to California

11/15/2006 California received it

11/18/2006 NOA1

02/01/2007 Aproveeeeed!!!

I-129F

12/02/2006 We sent I-129F

12/06/2006 they received it

12/11/2006 NOA1

12/15/2006 they moved our process to CSC

12/18/2006 CSC received it

02/01/2007 Aproveeeeeed!!!

02/15/2007 NVC signed our case number and sent to Rio Consulate

03/21/2007 We sent the packet 3

03/23/2007 Today we received the packet4 from Rio consulate

04/11/2007 Medical exame completed

04/16/2007 visa tax payed

04/24/2007 Interview - Visa Aproved

06/06/2007 POE!!!!!!!!!!!!! I cant wait to be with my husband!!!!!!!!

Second phase:

01/04/2008 Notice Date

01/23/2008 Biometric appointment (done)- They corrected my name ( I have 4 names and on the NOA they wrote just 3 names)

02/21/2008 EAD card ordered

02/26/2008 EAD card ordered (AGAIN???)

02/28/2008 EAD Aproved (it s very strange! did they order firstly and after aprove it????)

02/20/2008 interview letter sent (I just received it 5 days after the date)

03/03/2008 EAD card received

03/07/2008 SSN aplied

03/14/2008 SSN received

04/10/2008 Interview appointment - Aproveeeeeeed

04/15/2008 GC already ordered - Yahooooooooooooooooooo ooo ooooo!

The difference is how long you've been married...CR1 is Conditional Permanent Residence status that applies if you've been married less than 2 years to your immigrant spouse. a CR1 green card expires after 2 years so once you've reached your two year anniversary, you can apply to have the 'condition' waived and you will receive a permanent residence green card that expires every 10 years. If you've been married longer than 2 years, then you will automatically be a permanent resident without the condition and will receive the normal 10 year green card

04/23/2007--NOA1 Date from CSC

10/15/2007--NOA2 Date, FINALLY!!

I-129F/K-3 visa

05/23/2007--NOA1 date, currently at NBC (MSC)

10/15/2007--APPROVED!!! (NOA2 Date)

11/09/2007--I-129F petition forwarded to U.S. Embassy in Lima, Peru

12/12/2007--interview in Lima, Peru...VISA APPROVED!!!

12/26/2007--POE was Miami, FL and final destination was Charlotte, NC

I-485/AOS and I-765/EAD

3/18/2008--NOA1 Date from MSC

4/08/2008--biometrics appointment

5/07/2008--I-765/EAD approved

5/14/2008--EAD received in the mail (albeit wrong birth year)

9/30/2008--AOS Interview...AOS APPROVED and I-551 stamped in Passport!!!

Actually, you have to apply to remove conditions 90 days before the 2 year mark of your entrance to the US, not the date of your anniversary.

CR-1

02/05/07 - I-130 sent to NSC

05/03/07 - NOA2

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

Yes but the previous answer mixed visa differences with removal of conditions.

The visa process is the same. You recieve an IR1 visa if you've been married two years by the time the visa is issued. Even if you have a CR1 visa issued, you will receive a ten year green card if your enter the US or complete AOS after your 2nd wedding anniversary. If you receive a two year conditional green card, you apply to remove the conditions 21 months after entering the US on the CR1 visa.

The two years can apply in multiple ways. It's situational.

Additionally, if you enter on a K3 visa and AOS is completed after the two year anniversary, you get the 10 year green card too. Before and its the two year green card. Theoretically, (depending on the circumstances) you could be married several years before you have a 10 year green card.

Not only is it the same process, it is the same visa. The code merely identifies the length of your marriage at the time the visa is issued. There is nothing for either you or the consular officer who issues the visa to chose - It is what it is.

As pushbrk has explained, what you can choose - if you are close enough before the 2-year wedding anniversary date - is an entry date to the USA such that your immigration status will be IR-1 rather than CR-1 when you enter. Others have already explained the advantage of having IR-1 immigrations status.

IR-1 means the green card that you will receive will expire after 10 years from the issuance date. You won't need to remove condition with this green card.

This is very useful information and I will share with my friend in the Philippines, he will soon be filing for an Ir-1. Thanks to all for the post :thumbs:

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Yea, I told him that his wife will probably have her 10 year card before Claudeth and Claudeth has been here with me almost two years. :D
