Hello,

        I as US citizen and I petitioned for my wife to come to US.  she arrived USA on Sep 02, 2016. She has a Permanent Resident Card. Sep 02, 2018 will be her second anniversary of her entering united states. She is required to file for conditional removal process before second anniversary ends in order to renew her green card.

 

The problem is that my wife intend to go on an extended time on a trip to India from April  - October 2018. Now my question is 

 

1) can my wife leave for india in April and  fill out conditional removal form  and mail it to USCIS, when its due (June 02, 2018). Will that work. 

2) Does she needs to be physically present during conditional removal process in USA.

3) My wife intend to stay more than 7 to 8 months in india. Will that cause issues with her immigration status. Since her Permanent resident card (green card) expires Sep 02, 2018 can she go to USCIS and extend the green card so she dont have any issue entering USA when she returns back in oct/nov 2018. 

4) Will she have any issues staying out of country for more than 6 months.

You can file for it and send it out only 90days before the card's expiration date. 

 

3. She needs to be present at least until she takes biometrics and receives the AP saying that the card is extended for another year or until processing of the ROC is complete

Usually 4-6 weeks after submission.  Six months should not be an issue, but she should be ready to answer questions as to why so long.
