Do I need her father's parental consent for I-130 for Minor Daughter out of wedlock

My ex and I was never been married but my daughter does carry his last name. Never gave support, with on and off communication with my daughter. My daughter was obviously living with my mom or me her whole life but do spend school holidays with her paternalfamilyl side.

 

My question is do I need his consent for her to travel with me here? Her petition was approved recently and just want to make sure I don't have to get this paperwork for her. Appreciate all your inputs. Thanks!

See an attorney to sort out her legal status. IMO, you should use an atttorney to draft all documents needed for international child custody and visitation situations.

 

Please note for future reference that In the US having his last name does not make him a legal parent. Also, in the US child support is not a determining factor for seeing a child. It sounds like she also has not always lived with you.  It sounds like she has a relationship with her father's family.  I hope that if she is allowed to move that you facilitate (and pay for) her visits to her father and his family. In the US,  the moving parent is frequently ordered to provide the transportation for visitation.

 

The other thing to consider for the future is whether the father and stepfather would be interested in step-parent adoption.

Thanks for the reply. I've been working overseas since she was 4 yrs old that's why she stayed mostly with my mom. 

 

She does have good relationship with her father's family. My husband wants to adopt her but given her relationship with her dad's family I don't think she would want it. Her dad doesn't have any issue giving the consent either just wasn't to know jud it's necessary.
