Aos processing time

Hi, my husband had a B1/B2 visa. We came to the states unexpectedly last year. While we were here he applied for AOS. He completed his fingerprinting the beginning of October. We are still waiting on his work visa and interview. Is it unusual to have to wait more than 180 days?

I've recently seen users report times of over a year, with someone checking in at 15 months (here's his timeline: http://www.visajourney.com/timeline/profile.php?id=229052). I think you've still got at least a couple of more months, if not many more.

My husband had a B1 / B2 visa. Last year we came unexpectedly to the states. Due to our situation we decided to AOS. My husband had his fingerprinting done the beginning of October. It's now around 180 days and he still hasn't gotten his work permit nor had his interview. Is this normal?

It happens... not having the Greencard interview yet is perfectly normal, not having the work permit after 180 days of filing is unusual, although it happens to some unlucky people especially if they had a RFIE. It's kind of what you need to expect when you decide to suddenly AOS from a tourist visa.

Request For Evidence. It's when they determine that the evidence you submitted is lacking or insufficient. They'll send you a request for evidence and you have to mail that evidence to them. This causes delays in processing.

 

An example might be if you sent off your petition without a required form or birth certificate. Instead of rejecting your petition, you'll get a RFE so you have a chance to send it to them without having to restart the whole thing.
