I have a question about the carta de antecedentes penales.  We got approved by USCIS on 3/16/18 TSC and on April 3rd my wife got her Carta antecedentes penales from the Nogales Police.  My question is this: if our interview in Juarez gets scheduled for July 10th for example would we be forced to get a brand new carta de antecedentes penales for the interview since it would be more than 90 days old?  The reason why I ask is because I heard from a notary where i live that people have been turned back for bringing a letter that is 91 days old to their interview.  It didnt make that much sense to me because the NVC is going to want us to send a copy of our letter with our IV and AOS packet.

Two things, generally speaking Police Certificate is only required to you K1 Interview and so there is no reason for you to get it a year back. Usually knowing that your interview is in a month from now, go ahead and request it then you still have your police certificate within the 90 period.

Important: Police certificates expire after one year, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued. If at the time of your interview the following three items (Link above) are all true, you must bring a new police certificate to your visa interview:

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

I wont know when my interview is for awhile because I am still waiting for NVC to assign me a case number.  We decided to get the police certificate this week to get ahead of the game since some of our friends that are going through juarez had to send a photocopy of their police certificate to NVC before the interview. I am pretty confident that after everything is done at NVC that our interview at the embassy will be between June-July.

In our case, ours was like 4 months old, and didn't have a problem at all.  Just make sure it's from the state (Fiscalia del Estado), not a municipal record. 

Ours says at the top with a seal; "Fiscalia General de Justicia Del Estado de Sonora".
