Divorce certificate vs current marriage dates? Invalid marriage?

So I'm unsure if our marriage is even valid. Before his last business trip, him and his exwife filed for divorce, a month later there was a court decision, saying it was terminated. While he was here she filed for child support etc.  Assuming she got the divorce certificate. He called the courts to confirm the divorce was finalized, they said yes. We assumed it was okay to get married. He went back to Russia and got his copy of the divorce certificate, which says the date it was issued and the day it “was made in the Divorce Registry on”  isafter we had gotten married. He's stamp says when he got the paperwork(after our wedding) and when the marriage dissolved(a month he arrived on a business trip, before we gotten married). Nothing on the https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/RussianFederation.html says what date it goes by, and when I was trying to read the translation from Russian into English, we assume that once she gets the document it would be good to go.

 

If we don't have a valid marriage, what the heck do we do now? He's currently here on another business trip so if we have to get remarried and go forth again, I guess we will have to do that. But what do I do about the paperwork I have already filled out and sent in? We are already on month 3. I'm really scared right now that we might have caused a ban on him that we didn't mean to create. I'm also really embarrassed that with all the research I have done, this is could be the cause of him not coming here. We thought about keep going on with the current petition, but I just don't know any more. We seriously think/thought he was free to marry. 

 

 

PS I have already filed a tax return as married but separately and file an exemption on him. Also I have switched my last name to his.

March 5th, 7th case was touched. Also UStraveldocs passport states "There is no status update available for the passport number submitted"

March 19: reply from Embassy Stating we have been approved and should get visa in 1-2 business days! 

March 20th: Issued!!!!! ViH: March 21st.

I think your "marriage" is invalid..paperwork dates matter....you will have to marry him legally, and restart  the process.  You should also amend your taxes.

I'm honestly hoping we can go to the court house and start getting the licence today. But how would I put it into the past marriages and why I had some documents under his last name before legally married. I'll be mending my taxes as soon as I get them. Just unsure how to do that.

Generally you need to dissolve the (invalid) marriage first...annulment comes to mind too.

How long does a hopefully normal annulment take? I'm now starting to looking at moving to Russia at the start of the year, assuming I'm allowed too. So I can go dfc.

1. Don't panic

2. I am in a 2nd marriage here after a divorce in Belarus (same laws as in Russia). So I need you to look at the divorce paper. The main thing is the date of court. He could take this document whenever he wants. 

3. Do you have an Apostile (from Russia) and translation of Divorce certificate?

 

 

May I know the divorce date and your marriage date?  If it is more than 1 month apart I believe you are good.

They filed on May 17 2017, judge ruled on June 20th 2017.  We got married on Oct 23rd 2017.

 

Edit: The certificate states nov 21 2017 for it being entered amd issued.

Dec 21st ready for Pick up. Dec 23rd pick up passport with no visa.  Was told due to holidays they resent passport incase Husband needed it, and to return it back on Jan 9th.

Jan 15th, sent off passport back to Embassy, Jan 16th case updated and received passport. 
Jan 24th case touched. Feb 1st sent email asking if they needed anything from us, replied Feb 5th stating still going thru AP, no change on website. Feb 13th, case was touched. March 5th sent email (not by travel docs) asking what we are waiting on, received auto email, unsure if case touched was touch per auto email.
March 5th, 7th case was touched. Also UStraveldocs passport states "There is no status update available for the passport number submitted"

March 15 Sent message via ustraveldocs about what's going on etc etc.
March 19: reply from Embassy Stating we have been approved and should get visa in 1-2 business days! 

March 20th: Issued!!!!! ViH: March 21st.
POE: Aiming for April 26th.

ROC (LA, CA Area): sent  April: 12th 2021, Case transferred June 17th. Bios Jan 4th 2022. Ready for schedule interview Jan 5th 2022. Interview scheduled on Jan 11th 2022 for Feb 18th 2022. Approved at interview. Green card sent Feb 23rd 2022. Green Card in hand Feb 28th 2022. 
Next N-400: Submitted May 27th 2023, bios being reused. 

IR-2 (Step daughter, Ukraine): Sent June 7th, 2021 via online. Case was actively being looked at since Nov 2nd 2021. Approval Feb 16. Case sent to NVC Feb 19th 2022. Interview Dec 17, VIH 18th, POE Dec 26th 2022.

That's great! You don't need to worry about any other dates on the divorce certificate.

In my state you dont have to show the divorce papers, they claim we have to make sure we are able to marry.

NOA2: June 28th 2018, new website. Old website: July 17th sent to DOS (finally appeared July 29th, after 206 days after petition sent and stating not found) Emails & texts: nothing. Hard Copy states NoA2 is June 27, 2018.
