Hello,

 

I am new to Visa Journey and this is my first post. I hope that I am posting in the right section, trying to learn my way around the site.

My situation is that I am an American citizen and I went through the K1 process and brought fiance who is now my wife over from Vietnam.

My wife's son who is 10 years old. Her son came over along with my wife but, because of his numerous behavioral problems in school, the neighborhood and in the household, I decided it would be best if I sent him to stay with his grandmother in Vietnam. His grandmother raised him since birth up until he came to the US with my wife at the age of 8. He returned to Vietnam this past February. Both he and my wife have been Green card holders for a year and a half now.

 

I do not want my step to come back to the US and live with my wife and I. The plan was to have him live with his grandmother in Vietnam until the end of this summer so that my wife and I could work on our marriage. He caused  a lot of problems between us. My wife wants him to come back but, I do not.

 

So my question is, how would I go about preventing his re-entry into the US?  or surrender his Green Card I'm not sure which direction to go. I hired an immigration attorney to assist with the K1 and Green Card process but, was told by him that he could not help me on this matter because both my wife and step son were his clients. I'd also like to know how this may affect my wife when she tries to renew her current Green Card.

 

This seems to be a good site with lots of information and help. I'm looking forward to spending some to here.

First and most obvious question, you are working on your marriage and at the same time want to block her son coming back.

 

How does that add up?

Make sure he stays out of the country for over a year.

 

That being said, if your wife wants her son to come back to the US and live with her, she'll tell you to file a new I-130 in his behalf.

If you refuse, your marriage is over.

 

Being married requires the willingness to compromise. If you ask a mother to decide between her child and you, I doubt that you'll come out as a winner.

When you marry a woman, you also marry her CHILDREN, regardless of whether or not you wanted to. That was your choice when getting involved with a single mother.

 

If my fiance / husband said things like that about my son .... I would be single.

 

Hopefully your wife does as a mother SHOULD and places her son above the jerk of a male she married.

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....
