I recently posted about my issues with my US citizen husband, he has been torturing me , threatening me for along time i was stupid never told anyone never called police on him but after he calms down we talk about it and i have videos of him admitting and saying sorry to me , he once chocked me because i put his weed in a different place, last week he started an argument and in the process he either ran into adoor or the things the things he was throwing hit him on the mouth, when he saw blood he called the police and told him i beat him 😭we didn’t fight at all he got hurt idk how , the police took me to jail and i got abond of 500$ which i paid my self Cause i have no family in America.. i was given a no victim contact yet he’s the only person i have , I cannot talk to his parents cause they wanted him to marry a chinese gal  so that’s obvious they don’t like me am sleeping jn my car right now😭sometimes with afreind ... idk what to do cause he always told me he will get me deported cause he’s a citizen,,, i was charged for domestic violence and i have court bext week ,, just wanted to know will i be able to remove conditions on my green card even without him ?? Cause he says he will never give me divorce and he won’t file for me again for the ROC also has anyone seen such a situation,, will the court take me back to jail again 😭😭😭am so scared am only 21yrs and he’s 28 i just need help cause i got no body to talk too ,, ur response will help thanks!!

I would look up what the wire taping laws are in your state and start secretly recording him with your phone if it's legal to do so in your state.

Thanks but am on a no victim contact I cannot see what he’s doing now

Have you been able to collect any evidence of your bonafide marriage like people suggested to you in February?

 

If you, indeed, have videos of your spouse apologizing for hurting you, have you given those to your attorney for your court case?

I have all the proof but I don’t have an attorney yet he told my freind that he won’t come to the court that the case will be dismissed

You are the accused in a criminal trial- you have the right to an attorney at no cost to you, Aka the ‘you have the right to an attorney. If you cannot afford an attorney one will be provided to you’ that you have heard a million times in tv shows and movies.

 

Removal of conditions is the least of your worries right now - land yourself a felony domestic violence conviction( or even a misdemeanor DV in some states) and you are deportable.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

He dropped the charges himself and the state had to drop the charges,, but am now so stressed about the removal of conditions idk if i will be denied or be deported that’s my worries ...he keeps saying that he didn’t know what he was thinking cause the truth is he lied about that ... that I should forgive him but the bad record is on me and am really worried of what’s going to happen on removal of conditions next year

Thank you all ,, that took time and give me advise,, my husband dropped the Charges and the case was closed and am wondering if it’s going to affect my status next year when i go to remove conditions on my Greencard? Thanks again!!

If all the charges were dropped you shouldnt have any issues with ROC because of it. You probably will still need to disclose the arrest and the outcome. Since the outcome was charges dropped there will be no impact. Your main concern should be separating from your husband and getting to a safe place. No one should live in an abusive situation. You got lucky this time that the false charges were dropped. Next time you may not be so lucky with the court. More importantly you are risking your safety being with him. Please find a safe place to stay. 

 

You also need to start filing divorce proceedings so you can ROC on your own. Your marriage is toxic and you deserve better.
