Hello,

I filed a petition  for adjustment of status based on marriage to US Citizen,  I made copies for every single form I submitted. However I received a letter from USCIS requesting for INITIAL EVIDENCE. The letter read

'' Submit an Englis translation with applicant foreign birth certificate issued by the appropriate civil authority. If the document is in a language other than English, you must submit a copy of the foreign language document and an English translation. If birth certificate is NOT available, you must submit acceptable  secondary evidence. e.t.c''

My question is my birth certificate is in ENGLISH so translation is not an issue, however, I was born 1983, but my initial birth certificate got missing, I got born  dated Novermeber 2017, and it was also registered  the same date.

I have read that birth certificate register after 1 year of birth will not be accepted by USCIS.  AM now confuse, because they only ask for my birth certificate.

ANY HELP PLEASE

OP, where are you from? My birth certificate is in English, however some word in it is not in English, so, I still need the translation of my birth certificate. Your birth certificate is fully English? The initial birth certificate is not an issue since what they are asking right now is only the translation of birth certificate.

certificate

I am from The Gambia, a English speaking country, everything is in ENGLISH.  I assumed USCIS is saying if it is not in ENGLISH, then u have to translate it.   I don't have that issue.

My issue is, I got my birth certificate replacement in November 2017 and it also registered the same date.  I have read online, that USCIS may not accept  any birth certificate is was not register within a year after birth.

Just confuse.

They might misplaced your birth certificate. I'm not sure whether the date is the problem.

A new birth certificate wouldn't be the issue...the issue can be when the original birth certificate is issued a year or more after birth (in which case they may ask for other evidence of birth to back it up such as witnesses, baptismal records, etc.).

Thank you all. In the mean time, since they asked for my birth certificate only, I have mailed that.  I will also work on secondary evidence in case they ask for it.

I pray they accept my birth certificate and continue  on the process.
