I have a question for a friend. Her fiancé was previously in a religious marriage and he put that as his previous marriage. They have 3 children but have parted ways. My friend is divorced and sent in her divorce decree on her side. What documents would he need to prove that he was in a religious marriage and not a legal one in his home country. They didn’t know about this website when they filed unfortunately and they will be soon adjudicated. Any suggestions? Has anyone been in this situation before? Thanks in advance!

A Religious marriage even though it was not through the government is still a legal marriage according to the US Government.

Ok what documents do he need to get to prove that it’s over? That was my question.

The legal requirements may be country based. What is his home country?

Then if it is Muslim have then gone through the Sharia Court to get divorced? If they have gone through Sharia court to get divorced then they need some type of documentation stating this fact from Court or the Imam.

They haven’t received a notification from USCIS yet but they wanted to be proactive just Incase they received a RFE. Thank you

Not a problem at all just trying to help. It's better to be proactive than reactive especially dealing with hard embassies like a lot of the African countries are.

 

Because you never know what the Embassy may pull up on you so it's better to have it and not need it than need it and not have it.

So have you actually gone through the divorce yet (presumably via a Sharia Court)?

If so, the it's just a documentation issue.

If not, then the existing petition will likely be denied as you were not considered free to marry at the time you filed the I-129F. Or if it does get through USCIS, the CO will want to see the paperwork to reconcile the past visa application's marital status.

It’s not me it’s for my friend that filed for her fiancé. Yes they did go through that procedure because the woman is already remarried to someone else. We just needed to know what physical evidence was needed for her fiancé if it was even asked.

In addition to what it was said above, evidence that the ex remarried could also be useful.
