Expiration on drivers license for CR-1 visa holder

Hi all,

 

My husband has officially been in the US for over a year now! But we discovered when he was applying for a new job, that his drivers license expired on the year anniversary of his entry into the US, as opposed to the two year expiry date of his green card. Is this intended behavior? Trying to figure out if it was a mistake, or if we just really dropped the ball, before he goes in to the DPS to get it fixed today. So for reference:

 

Entry to US: 2017-02-09

Expiration of DL: 2018-02-09

Expiration of Green Card: 2019-02-09

 

We live in Oklahoma, FYI.

Timeline

I have never heard of a driver's license expiration date being tied to POE date.  Usually expire in the birth month.... at least in Arkansas and Texas..  Example:  My wife entered the US in June of 2017. Driver's license was issued in October.  Her birth month is August.  Her driver's license also expires in the month of August..of 2024.........

by the way, my wife entered on a CR-1.  Her driver's license is valid for almost 7 years.....yay, Texas!!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hmm.. could it be because we didn't have his actual green card at the time? I think we had his social security card by that point, but not his physical green card. His license also has a big red TEMPORARY CARD at the top.

Oh......that sounds reasonable.......I think that is probably the answer......

Each state has it's own laws.  When we lived in NJ, my husband got a drivers license with his EAD, and it expired in 2 years and 2 months (go figure).  When we moved to NV, his license was issued for 8 years in spite of his having a conditional green card.

 

Your best bet is to google the department of motor vehicles for your state, and read the licensing rules there.

Yea, part of the problem with the OKDPS is that there is pretty poor documentation, especially when it comes to immigration.

 

But either way, after waiting in line at the DPS for over THREE HOURS, he was able to renew his drivers license, and it is good for four years this time.
