Does anyone know of a case that was denied?  And because of what reason?

Thank You and Best Wishes,

Chris

I know of a few. At the inteview pictures were shown of a engagement party and the CO interrupt them as a marriage ceremony and their visa was denied. I know someone who forgot to sign, and it was specified to sign the RFE and it was denied. I personally was attending my wife's interview and I was sitting in the waiting area of the Embassy and overheard a interview and a sister was trying to get a visa to take her sister's child and herself which is a fraud and the CO uncovered that and denied the visa. There are too many to list but I am not sure why you are interested in this line of questioning. Can you give more details.

Does anyone know how complicated the process can be if my fiancé was already married and his ex-wife was a Latina and also got benefits by marrying him? They separated 3 years ago!

That was a very short period of time, three years. I am sure it will be scrutinized a little more then cases with those who divorced after 10 plus years. If you have divorce papers from the court and your relationship is genuine and you can prove so with visits and such then you could be ok. No one can say for sure as we are not trained to view and interrupt the "evidence" from I-129f packets and background checks.

Start your preparation now. Here are some items for you to be aware of.  I don't have the P3 instructions for your Embassy. If and when you get a copy if you could share with me then I would be able to share with others who come behind you.  Here are a few things that I did find the can be used as a primer.

From the Serbia Embassy's website: Interviews are by appointment only! You will receive an appointment when you have submitted your notice of readiness confirming that you have all the required paperwork in your possession. Embassy Belgrade will notify you of your interview date and time and paying the MRV application fee by an appointment letter.

Required Documentation

You, the foreign-citizen fiancé(e), (and eligible children applying for K-2 visas) will be required to bring the following forms and documents to the visa interview:

  • Completed Form DS-160, Online Nonimmigrant Visa Application. You (and any eligible children applying for K-2 visas) must: (1) complete Form DS-160 and (2) print the DS-160 confirmation page to bring to your interview.
  • A passport valid for travel to the United States and with a validity date at least six months beyond your intended period of stay in the U.S. (unless country-specific agreements provide exemptions).
  • Divorce or death certificate(s) of any previous spouse(s) for both you and the U.S. citizen sponsor
  • Police certificates from your present country of residence and all countries where you have lived for six months or more since age 16 (Police certificates are also required for accompanying children age 16 or older)
  • Medical examination (vaccinations are optional, see below)
  • Evidence of financial support (Form I-134, Affidavit of Support, may be requested)
  • Two (2) 2x2 photographs. See the required photo format explained in Photograph Requirements
  • Evidence of relationship with your U.S. citizen fiancé(e)
  • Payment of fees, as explained below

Note: The consular officer may ask for additional information, such as photographs and other proof that the relationship with your U.S. citizen fiancé(e) is genuine. Documents in foreign languages, other than the language of the country in which the application takes place, should be translated. Applicants should take to the visa interview clear, legible photocopies of civil documents and translations, such as birth and divorce certificates. Original documents and translations will be returned.

Of course, I will pass you on all the info I gather on the embassy here in Belgrade as soon as I can. I know I would like to know each step of this NVC - Belgrade embassy road, so I will share with you to make it easier for others in future.Thank you for being such a helping hand!

@Greenbaum

Thank you very much for your response, they were married for about 1 year and 6 months, they separated 3 years ago and a little more, the legal divorce documents came out more than a year ago, they were attached to our I-129 package, the I have been on trips for 2 weeks for three times, we have made trips together and we hope that our process comes out soon, otherwise we are planning to spend the new year together. I hope you can help me with more information. Thank you

Yes it would be great if you could get it when you are together,  is this your second time in HCMC,  what do you like about HCMC,  and did you rent a motorbike?

If every day I expect good news and only the weekend arrives without any progress. All these words are only anxiety and despair. I hope with faith that there is good news soon. ☹️

Haven't been to HCMC. My fiancee is from Hai Phong and I was there for about 10 days back in May. This will be her first trip to HCMC as well. I am only there for 3 days. We are going to take a dinner cruise on Friday night then just kinda hang out together on Saturday. Not really wanting to try and cram a lot of stuff into a really short visit.

I like to pick on my fiance and refer to HCMC as Crazy City because of how wild their traffic is.  I am also going back to Vietnam myself and will be there from 12 Nov to 10 Dec. Hoping I either hear back that my RFE was either approved or denied before I get there or while I am there with her as well so I can help her with all of the other forms she may need to do and help her set up appointments and what not for vaccines and . lol Maybe we can cross paths while there.

This will be my 2nd going time to HCMC. HCMC is nice in a sense. I have only driven cars and told her there was no way in hell I was gonna practice riding a motorbike for her and risk getting injured haha. This time around I told her I may attempt to ride one since we plan on spending some time out in the countryside with her family for an engagement party. How about yourself?
