Misunderstood. I read already the letter. I'm just asking if to send the TOS for the website it is enough. They only asked to my fiance proofs that Skout site is not IMB.

Do only what the RFE ask for. Since I don't have a copy of it in front of me and you have not posted it I'm afraid I can only help you understand the need to be careful. Good luck.

Go online to Skout and look for their TOS (Terms of Service) and make a copy. Next send an email to Skout and explain to them what you are working with and that you would appreciate a letter that address this issue (see red highlights below) with USCIS:

 

Please be advised that section 4 (B) (ii) of IMBRA exempts dating 

companies whose principal business is not to provide dating services 

between US citizens and foreign nationals so long as it charges 

comparable rates and offers comparable services to all individuals 

regardless of gender or country of citizenship. Consequently our 

company is exempt as it falls within this exemption (as do many other 

large dating companies). 

 

Take the Skout letter and the Skout TOS along with a letter (see example of letter below) from you and send back with a copy of the RFE. Be sure to make a copy of everything you send back. Also, send it so you can track the package to USCIS. Both of you should sign the letter. You can send it to the other for signature as a pdf attached to an email. Print and signed and the scan and return for inclusion into your reply back to USCIS.

 

To whom it may concern:

 

I met my fiancé on Skout and to my knowledge and evidence by the enclosed letter, Skout is not an International Marriage Broker. There are no introductions or matchmaking services or social referrals between US Citizens and foreign nationals. There are no written consent forms or contracts that members are required to sign. Members search and communicate with others from their own free will.

 

My fiancée or I did not pay or signed a written consent authorizing the release of personal information. There were no introductions, both of us communicated with our own free will. I have enclosed a copy of the letter from Skout's stating that they are not a IMB company and they do now run their website as such.

 

I hope this gives you a better insight on the workings and our experience with Skout.

You must provide the WAC#, DOB, names, then sign and date to insure this gets included with your case.

@Greenbaum What great help you are brother ! I really need your advise here .. On page 9 from the I-129F Part 3 , I think shoud have checked the box 5.d. ( Not applicable , beneficiary is my spouse or I am not a multiple filer ) 

I didn’t check box , thinking if I check it , it will confise the officer as the beneficiary is a wife then RFE that .. insteat on page 13 ... i put Page 9 Part 3 Item 5d ( No applicable , beneficiary is my fiance and I am not a multiple filer ) i will attach that so you can see it .. Do you think I need to use the e-request tool to check the box or what I did on page 13 is enough for why ididn’t choose to check the box ? Or probably wait and see if i get RFE ? Please see attached and your answer highly appreciate it .

Thanks so much for the info! I think I might wait until next week if I don’t get the NOA2 I will reach out. Hopefully it falls into good hands and they realize I did state how we met on the declaration of meeting. Thank you once again.

Item Numbers 5.a. - 5.d. Multiple Filer Waiver Request. You must request a waiver of the International Marriage Broker Regulation Act (IMBRA) filing limitations if:

  1. You are filing this petition on behalf of your fiancé(e) and you previously filed Form I-129Fs on behalf of two or more fiancé(e) beneficiaries; or
  2. You are filing this petition on behalf of your fiancé(e), you have previously had a Form I-129F approved, and less than two years have passed since the filing date of your previously approved petition.

If you have not filed a petition on someone else then the answer is N/A or no.

 

I would recommend that you make an attempt at submitting an explanation as to your answers. If I was the adjudicator I would see your mistake but since this is a legal document between you and the US Government I'd advise to put a letter/email together and explain your misunderstanding. Follow what is needed from my other post.

I have seen other couples get Denied because they failed to have met within the 2 year requirement and that is basically what you are saying. You might get and RFE and you might be denied. Jezzz I hate the game of Russian Roulette. I just will never know which chamber the bullet is in from the gun that's being held to my head. Mmmm. Just my thoughts and your mileage may vary.

I am not multiple filer , this was the first time I file I-129F , I think I should have checked the box 5.d. but I didn't , however I mentioned on page 13 the question number and I answered it , please see the pictures here and I would appreciate a template answer from you so I can do it exactly as you see , Thank you again , here is exactly what I did
