British Passport Expired and no Green card

I entered the US on a K1 Visa with my 7 year old son in January 2006. After getting married I applied for both my son's and my permanent resident I-485. I received my green card in August 06 but they "lost" my son's application and are still processing it now....

Well my son's British passport has now expired and he has no other ID if we need to travel etc I can apply for a new one at the British consulate but I have to return the old one with the Visa in it, does anyone think I should or just wait until the Green card arrives?

You do not need a Greencard to get a new UK passport.....

They will return the old one to you along with your new passport... so it is not a problem....

They will return the old passport with the new one.

It took less than 2 weeks to get them back.

When I sent off mine, it didn't take long at all, probably about a week or so and all they do is make it so that the passport is invalid and cannot then be used by someone else.

As you know in most instances you cannot travel on the greencard alone so a new or replacement passport will be required.

Regardless of if you have your greencard or not, you should always have a valid passport. Even if you're not travelling, it's a valid form of international ID.
