Hello everyone! Recently we have gotten an RFE from Uscis about my fiancés divorce certificate. She is from Ukraine and the divorce certificates are processed different here than USA. She has been married twice. Once in Ukraine and once in Russia. The certificates look the same, but they need clarification on the Ukrainian divorce. My fiancé says that what we sent to them is the only thing she can get because they do not get divorced in a court unless there are children or property involved. Weird thing is her Russian marriage was after the Ukrainian marriage so it would have been legally terminated to be allowed to marry in Russia later. Has anyone had this issue and how was it resolved? Thanks in advance.

But what is the exact wording of what they ask for? They are probably looking for the stamp that says that divorce is final or some confirmation that it's final.

Proof of legal termination of marriage   Submit a legible copy of the legal termination of marriage of Maryna  and Dennis .Such proof would normally be a final (absolute) divorce decree, death certificate, annulment etc...In order for a legal termination of a marriage to be valid for immigration purposes, it generally must be valid in the jurisdiction where it was terminated. In addition, the divorce must also be recognized in the jurisdiction where any subsequent marriage occurred.Note: A divorce nisi is not considered to be evidence of a final divorce.

After reading this post, I'm guessing I'm going to get an RFE for the same thing. We submitted my fiancées standard divorce papers in the I-129f. She has the documents from ZAGS, but she got them in preparation for the interview. So, is there anyway to submit the documents to USCIS prior to them issuing an RFE ?

Thanks

I'm not positive if there is a way to send additional info at I-129F stage. Only if RFE has been issued I believe.

They may not even send you one - it all depends on a person, working on your case.

Well I know I'm in line for an RFE. I came across this website a few weeks ago and had forgotten about it till just now. I found it on the Canada immigration forums (not vj.com) someone had posted, I had talked to a few people stating they were very pleased with the service of this lawyer. Seeing how much husband feels for his safety of his life if he enters Ukraine to get these documents, I think this might be well worth the money spent. Looks like the lawyer only charges about 89$(5500 rubles) per document he has to get, with English translation, apostille and he emails you a copy and sends you a hard copy for that price.

I'm currently in the middle of making a request to him for these documents. He also does police certificates.

Hey, just wanted to clarify about our RFE. Our lawyer called the actual officer working on our case and she said that these papers were "missing". Lost? So, we sent the same papers along with proof of civilian paper. We got our approval Friday the 27th. So, if you sent the Zags paperwork, you will be OK! Just wanted to lighten your worries about this situation. Your approval will be coming soon!! Good luck with the whole process and I hope I made your day a little brighter!

So an update on my petition so far, we got our i-130 approved using this divorce certificate, no RFEs. This certificate is even issued to my husband’s ex-wife. I’m still going to have him request one in his name, his internal passport supports the divorce date on this document, even though he lost his and this was issued some years after it was registered. So I don't know if this is a copy of the 1st or the 1st one issued to her.

He was married in Crimea and divorced there, and this document is thankfully with the Ukrainian government seal etc.
