It’s weird. Everyone else at VSC have started receiving NOA. Mine is still not in the system. Lol. I’m gonna relax another 30 days 🤣🤣.

Most of you following this thread probably have heard my story multiple times. But for those that don't know, I will explain my situation and then explain how I resolved it.

 

- Application filed (arrived) at CSC on Apr 10th.

- Quit my old job on April 20.

- GC expired on April 26.

- Initial plan was to start my new job on May 7th. I was so sure that I would have my NOA by then. How silly of me!

- New employer needs unexpired work authorization document as part of I-9 verification. I kept pushing my start date (3 times) every week by one week.

- Needless to say, my check hasn't been cashed yet. And my future employer was clearly beginning to get antsy. 

 

So what did I do?

- Requested an appointment (online) with the SF field office. I had to wait for an officer to call me (this is how it works at California field offices). I told them my sad story and convinced him to grant me an appointment. I also convinced him to key in a dummy receipt # in his system in order for him to set up an appointment. This is the only way he can schedule one.

- Went to the field office this morning with the following documents:

    - Appointment receipt

    - Printed form showing FedEx receipt and signature (at CSC)

    - Expired green card

    - Copy of the I-751 documents filed

    - Copy of check that was mailed with the documents

    - Offer letter from future employer. It's a good offer. So I made sure to highlight it and show why I can't afford to lose it.

    - Another letter I got the legal/HR team from my future employer to write which highlights the urgency of my immediate work commencment.

    - Proof of students loans and other documents to show why this job is vital to my financial health.

- Told the agent my sad situation (all true, BTW) and pleaded her to make an exception and give me a stamp in the passport.

 

The agent was empathetic and compassionate. She discussed my case at length with her supervisor and kindly offered a 3 month stamp. I was ecstatic to hear that. I really lucked out with this wonderful woman who took the time to understand my situation and verify that everything I claimed is true and then make the right decision (to make an exception and grant me the stamp since this is a delay on the CSC end that we shouldn't have to suffer for).

 

Spoke to my future employer - all set. I start on Monday. I was a nervous wreck this past couple of weeks. I can finally breathe a sign of relief! Hope my experience helps others. Good luck, guys!

 

 

Hi, I have a question since I am also from San Francisco and my green card expired last April 26th  as well. Our attorney filed the application for us the same week our green card expires (April 20-something) and until now I haven't received any Notice of Action. My daughter needs to go to the Philippines late May or early June. I've read some forums saying that an unexpired GC and NOA would be sufficient in re-entry to the US. I do hope that we would receive the NOA next week so she can book her flight. Do you think we would receive the NOA by next week? Also, if the biometrics appointment letter takes longer, I don't think she'll be here by then. Can we reschedule the biometrics? She goes back to San Francisco on August 5. 

Any thoughts?

Hi all,

We are getting our paperwork together, as our window is just opening.

I am stumped by the question on the form asking for the Alien Registration Number. I was under the impression that she doesn't have one, but the GC has a 9-digit number. Should that 9 digit number be on the form?

The A# is the USCIS 9-digit number on your GC

Yes, we got a letter the day I posted this and then today we got another one - identical to the first, but dated 6 days later.  

I could not stop laughing (you'll understand this)!  It took over 2 years for us to get a letter back from a 2014 inquiry with all that waiting at TSC.  Now they are so excited they send the same notice twice.  

I wondered if it was because we have daughter on the application as well, but the only difference between the two is the issue date.

I wish I knew enough to answer your questions. I am sure there are other folks here who  could answers some of them. Regardless, if you have an immigration lawyer, you should depend on their counsel.

 

Looks like your application was filed mid-April. As it stands you should expect around 45-60 days to get your NOA. From what I know, if you leave the country, you will not be able to re-enter without the NOA. In fact, I would go one step beyond that. As soon as you get your NOA, get an I-551 stamp on your passport. Once you do that, travel shouldn't be a problem. Regarding biometrics, from what I know, you should be able to reschedule if you have to.

 

I urge you to double check all this with your lawyer.

My daughter is the one leaving the country and not me. She asked me if she could leave the US without NOA but as soon as I receive it here, I'll send a copy to her so that she can show it to the customs when she goes back. Hmm :mellow:

There are no guarantees, but my wife called customs border control at the Detroit/Windsor border and she was told that they can see if the application was received in their system and that the NOA in hand was not necessarily needed. With that said, you should call and see if you get the same answer and use that as a last resort. It would definitely help if she had a copy of the NOA you send her on hand.

Note that received and in the system are two different things. It’s not in the system until the day of or the day before the NOA is completed.

 

thats why we have so many people here who are being told by the service centers reps that they don’t see their application in the system, when the caller knows they received it through tracking.

Right thanks for clarifying. I was very detailed in my previous post about this so I forgot to mention it again. You would have to see that your check cleared and/or call and confirm that they have done the intial entry of your application. My point is those that we were told you don’t need the NOA in hand and customs can look it up.

Looks like you’re just a couple days ahead of Daniel. We got the biometrics waiver letter too a few days after you. Nice to have a friendly face to sit through this wait with us!
