Gunner49,

Since you still have a valid GC, all you have to do is go to the DMV and request a renewal DL for damage/lost *Wink*Wink* or tell them I don't like my DL picture! pay the fees and get a new one for 6 years or so lol problem solved!

So I just found out the answer to my question and that is "No".

Here's the official excerpt from the TN DMV.

"If your driver license has been lost, stolen or destroyed, you may be eligible to obtain a replacement online. Obtaining a replacement license does not change the expiration date of the original issued license"

So guys, its been a month since I filed and my GC expires next week. I think I going to refile tomorrow. I have my packet ready to go. At Least gives me peace of mind.

Thoughts?

If your first submitted packet is correct, don't do this.

I would highly suggest you don't.   There's a ton of us and throwing more into the mix is not going to help.  My husbands is already expired...you will be fine.

Don't do it!!! Like others said, if your first packet was done correct then you're just going to add to the backlog and waste your time and money. the Immigration attorney i spoke with also recommended me not to resend it. Just have to wait for them to acknowledge they received our package with the NOA. they should be starting to process the CSC packets since the H1Bs have been entered into their system....as per their website. your permanent resident status doesn't get revoked because your going through the ROC process.

They will run your check twice, you will get charged twice.

you're not the only person in this boat and sending in more papers to flood the already overwhelmed system isn't going to help, and it'll cost you 1300$. The fee is an application fee, they will charge you simply for opening and attempting to process the papers, even if  they already have an application for you,

Did you send the package with a tracker? That's the most peace of mind you can get at the end of the day.

And again, they're saying that it's a 60 day wait. That means 60 days until you even hear that they received it. They're well aware it's taking a while.

Some Tier 2 agents told people to resend when they called a couple of weeks ago ... So I am sure a lot of people already did that and will lose their money.

Yep, probably. I’m sure somewhere down the line there will be some kind of recourse to obtain the money back. In the meantime I’d stick with the most recent advice of not refiling and just waiting for that 60day timeline, however frustrating or inconvenient that may be. No point in clogging the system with identical applications, they’re clearly not geared up to even deal with the amount they’re currently receiving!

DON'T DO IT! it will be counter-productive and will not address the underlying issue. The reason you have not heard anything is because they have not gotten to your application, NOT because they have lost it. As you can tell, there are others in the same boat so your experience is not an anomaly. Also, sending in a duplicate application may just confuse them and may even lead to a longer delay.

Yeah, same here. Still "interesting" how everything seems to go wrong these days 😉

Day 32 now and waiting for CSC to get in gear. I was gonna call but then read on here about the 60 days. Glad I did file at the very beginning of the 90 day window so except for me not liking to wait until they finally cash that check I should be okay... Hopefully!

What I find kinda funny is that we got our application back within a week when we sent it the first time because we didn't include a copy of the marriage certificate (ugh!) so it seems like someone is at the least checking the applications once they come in and then throw them on a pile or something...

They returned because Marraige certificate was missing  but they didn't include that as an initial evidence in the instruction

I know, I was so mad! I guess someone at CSC just messed up. Re-sent it with a copy of the certificate and been waiting since then. Oh well...

We also have to remember that these reps are getting most likely angry calls constantly.

im not saying that “just resend the application” is the right answer, but it’s an easy answer that will get someone off the phone (and give them more money).

We always need to remember to weed out the answers that don’t make sense, which we’ve seen in this thread, and make sure to post our experiences here and always get a second opinion.

If 99% of people here say X, and 2 out of 3 tier 2 reps say X, but 9 regular reps, one tier 2 rep, and a very small number of people say Y, the reasonable answer is still X.

So I just found out the answer to my question and that is "No".

Here's the official excerpt from the TN DMV.

"If your driver license has been lost, stolen or destroyed, you may be eligible to obtain a replacement online. Obtaining a replacement license does not change the expiration date of the original issued license"

LINK: https://www.tn.gov/safety/driver-services/classd/dlduplicate.html

OK as you've mentioned that your driver license is going to expire very soon, why not just go over to the DMV and ask for renewal. I'm sure the DMV will understand that you trying to have a valid DL and not waiting or wanting to diver with expired one. I'd recommend that you at least try to g to DMV and renew it with your GC still valid.

How early can I renew my TN drivers license?
Your Tennessee driver's license expires on your birthday every 8 years. 8 to 10 weeks before your expiration date, the Tennessee DMV will mail you a renewal notice that will indicate if you can renew: Online. By mail.

I hope this will help.  Good Luck!
