I just got off the phone with the HR manager from my job. It turns out her sister works for USCIS. She said that people who are going through the ROC process can still work on an expired green card and with the restriction on their social security card.

Only can continue to work not apply for new work since they have to go through the whole new I-9 process.

Can you confirm that we can apply for a new job once we finally receive that 1 year extension notice?

This is how I understand things if you read the I-9 acceptable documents.

If you look at the subsection for Class C documents you'll find:

Quote

A Form I-797 issued to a conditional resident may be an acceptable List C document in combination with his or her expired Form I-551. For more information about DHS-issued documents please contact user support.

Class A: green card or EAD among other items.

Class B: driver's license or ID

Class C: unrestricted SSN or I-797, among other items.

The rules are also clear:

Quote

The documents on List A show both identity and employment authorization. Employees presenting an acceptable List A document should not be asked to present any other document. Some List A documents are in fact a combination of 2 or more documents. In these cases, the documents presented together count as one List A document. The documents on List B establish only identity. Employees who choose to present a List B document must also present a document from List C for Section 2. Employees may present one of the following unexpired List B documents:  Employees who choose to present a List C document must also provide a document from List B for Section 2. https://www.uscis.gov/i-9-central/acceptable-documents/list-documents/form-i-9-acceptable-documents

Quote

Your employer may NOT:  Demand a specific document when reverifying that you are authorized to work. You may present any document either from List A or from List C of the Lists of Acceptable Documents to demonstrate that you are still authorized to work. Refuse to accept your document or refuse to hire you because your document expires in the future.  https://www.uscis.gov/i-9-central/employee-rights-discrimination/employee-rights

Did anyone have any luck in getting an i 551 stamp on their passport?

I am going to try on Friday. Will let the group know as soon as I am back.

As for going to a local Social Security office to get the restriction removed on my SSN, they said it's not possible since my GC is expired. The system will not accept it. I explained my situation to them (GC expired, new job offer in hand, yada yada yada) and they suggested that I go to a field office and ask for a stamp. They said the field offices have much more power in what they can do.

I'm a nervous part of the CSC backlog too.

Used UPS to delivery overnight early AM, sent 4/11 delivered 4/12. I'm getting a little nervous since I used UPS and the overnight address (24000 AVILA RD, #2312) I have proof of delivery with a signature.

I'm trying to find out if they can at least confirm receipt of the package and whether it's in good order since my GC expires on 05/23 but no luck so far. Made an InfoPass appointment and was told to wait a few more days by the officer in person.

My biggest fear is the app being rejected after the GC expires-- what recourse do we have then? I'm tempted to file another form via USPS just as a backup.. Anyone see a downside in doing so?

I would not recommend re-filing. The only reason to re-file would be if they lost your package, and that is clearly not the case. There is clearly a backlog and it is unfathomable that they would just misplace packages on whim. I am sure your application is there, waiting to be looked at by someone. I think sending in another application would be counter-productive. Let's hope the CSC gets their act together soon. I think the only recourse right now is to call them and make sure they know that this is causing real angst for people and also perhaps schedule an infopass appointment. The more people complain, the more likely it is that someone responsible takes notice and tries to move things along. Just my two cents. Good luck!

THANK YOU for this!! Hopefully. I am wondering about the situation regarding the Formerly issued green card errors. Does that take precedence over the I-751? Or would they do it simultaneously..etc..?

I think the replacement cards for those with the error will be handled by NBC center as there is where green cards are produced, so my guess is (and really hope this is the case) that service centers (California & Vermont) will not be involved in this process.

Ugh, I just want to vent because I'm feeling super stressed out today... My GC expire yesterday and it's been almost a month since I submitted my application to CSC

I'm kind of freaking out because we are going to Brazil in August, but it's not just a vacation, it's my freaking wedding. :( We got married here and had a really small ceremony at his church, just for parents and siblings, but my dad has always dreamed of walking his baby daughter down the isle at his church, so we decided to do the BIG wedding in Brazil. Hubby is an Infantryman in the Army, and at any given moment he could be deployed, so we decided to hold off the wedding for after he was out of the Army (his contract is up in July) because we didn't wanna risk him not being able to attend.

Knowing that I had to have my papers in order I was organizing my documents to send my package as soon as my window opened, in the first half of February. Except that a few days before my window opened I had a serious complication in my pregnancy and our baby was born two months premature. I stayed in the hospital for a couple of weeks, and after they discharged me I didn't get to come home because my baby was still in the NICU in a different city, and I stayed there with him. And honestly ROC was the last thing on my mind back then.

But I finally mailed my package about a month before my GC expires thinking it was plenty of time for me to get the NOA1, cause that's all I need really. I couldn't care less if the whole thing took years honestly. And now there's that.

And I'm freaking out they'll return my package for some silly reason like I didn't include my marriage certificate, and then it'll be another two months until they actually send my NOA1 and I can't make it to my own Wedding. :(

I'm terrified, my parents spent like 30k on the wedding so far, all my American family has purchased tickets and booked hotels, and I'm freaking out I won't be able to be there. :( Funny how I was afraid my hubby wouldn't be at the wedding and now I'm the one that might not be able to show up, lol

I really hope they start moving this processes soon. Fingers crossed!

Good to hear. I hope you're right. Hopefully we'll see some movement for CSC soon!
