Code 5 – one-hand fingerprints (4 prints on one hand), photo and signature.

The Bio apt letters could be due to the fact they mass sent out bio-reuse letters. It seems like between the 22nd-27th of February, they were just sending them out in mass all at once. It's possible they discovered their mistake in doing so and are going back case by case and fixing it.

Timeline

Hi all,

Hoping for some advice:

We got a RFE 1 week ago, stating that they wanted additional proof of financial cohabitation. The house me and my husband live in, with our mother-in-law was purchased fully by her and is in her name. Thus, we have no mortgage and do not pay her rent, we live as a joint family. Initially, I was the only one working and my husband began working a 1-1.5 years later at which time we offered to pay for internet but she was still paying for the electricity and hydro. My question is how to go about showing that we are in fact cohabiting, but there is no mortage, bc we have none. We dont have receipts for rent, because we dont pay any. We have transferred the hydro and electricity under our name and to be withdrawn from our account and will be providing statements for that. What other things could we use to show stronger financial evidence?

We have already provided statements of our CC, joint accounts. 

 

This has been immensely stressful for me, and I am hoping for some additional advice to check off as many boxes before we submit the RFE.

Did you include any affidavits with your application? In our case, because we also live in someone else's home, we wrote an affidavit explaining our living situation and any contributions we offer. We also got the other individuals in the home to write an affidavit attesting to everything. Did you send all statements for the joint CC and joint bank accounts or other joint bills? Copies of the cards? Tax transcripts?

We included all CC statements, joint tax filings. I think the only thing we didn't do was get an affidavit from my MIL which we are going to send this time. We sent copies of the joint bills we had at that time (internet and car insurance), but we have also transferred the hydro and electricity to our account now so we will be sending that as well.

I have looked at that date 100 times and the 8 is an 8 Lol. The day and  month are correct, however the year is the problem. Now I have to file an i90 form with evidence is not my fault. Frustrating....

There are a few things you can do. The most important in my opinion is a joint bank account. Doesnt matter how long its been, I would open one up ASAP if you already dont have one. Another thing Id suggest is a will, naming each other as beneficiaries. Get a car loan if you've been thinking about getting a new one, that will help as well

I wouldn't recommend that for two reasons. First, it's clearly pretextual -- it'll be obvious to USCIS that you're just trying to game the system. Second, it's weak evidence of co-mingling, since it (a) will likely not contain sufficient transactions, and (b) does not cover financial history from marriage (or as far back as possible) to the present time.

 

@yuna628's idea is better: An affidavit from MIL stating 1) when you guys starting living with her, 2) what the living arrangements are (how you share the space), and 3) how you guys share costs (even if it's cash contribution). I would corroborate this affidavit with:

  • A cover letter from you also explaining your living arrangements
  • Government-issued ID cards for both of you with the house address
  • A series of utility bills addressed to MIL (e.g., one per quarter) from the time you moved in to the present
  • Annotated pictures of you guys and MIL in the house (e.g., during major holidays/birthdays/other events from the time of marriage to the present -- like "Christmas 2016", "Thanksgiving Turkey Carving, 2017", "Spouse's Birthday 2018", and "MIL's 60th anniversary, 2019")
  • Letters addressed to both of you at the address.

You can also submit evidence of beneficiary nominations on retirement accounts, health insurance (form 1095-B), etc... Good luck!

What about Tax Returns? Sign up for an account on irs.gov and download your tax transcripts. That would be an important piece of information.

 

You can also get Power of Attorney document made and send it to USCIS.

 

Do you and/or your husband have a retirement account from your workplace? e.g. 401(k)? You should have your spouse added as beneficiary there and print out the beneficiary page and send it to USCIS.
