One thing to support your assertion, if I am to argue in favor, is that H1B petitions can pay for premium processing “some” actions must be taken within 15 business days for those premium filers.  USCIS sometimes scams people for more money on premium processing by issuing RFE on day 15th, instead of approving it, claiming that it lacks something.  No surprise there, we see the same thing here, but note that I don’t believe that all I-751 RFEs are issued without merit.

If this is the case, I can understand CSC actions. Why then we have no movement from VSC? Especially if biometrics are in place for the majority of applicants.

@Cougarfalcon83 - you must be special.  Let them pick it up and just do it. No need to transfer

If it goes to the local office, yes, your lawyer is correct.

BUT earlier in 2018, February 2018 to be exact, TONS of cases have been updated to reflect that files were transferred to a local office and that turns out to be a glitch that is now widely known.  So it is possible that your update could be a glitch too.

I got email last night saying  " case transfer and new office has jurisdiction "  AND got another email this morning saying  " case was received at my local office "                         Anyone have any idea what going on ? is it good or bad ?

I have biometric appointment for 03/11/2019 at 8am

I believe there is change in process last year end and or since 2017 .

as per change interview is highly likely in most of the cases which explains cases being transferred in different offices :

No, that is not true.  Transfer to another Service Center has nothing to do with this guideline.  This guideline only applies to case filed on or after December 10, 2018.  The guideline replaces the 2005 interview waiver guideline memo, but essentially they are saying the same thing.

 

The main difference is: for cases received on or after December 10, 2018, interview is required if the petitioners have not been interviewed yet prior to filing I-751.  This effects a portion of I-751 filers only.  The majority of I-751 filers have been interviewed jointly with their spouse during AOS (I-485).  Only those who came on a financé visa (K-1) received an interview waiver after they arrived in the US and later filed I-485.  This is because the K-1 visa holder has already been interviewed in their respective country prior to coming to the US, but their spouse (US citizen) has not been interviewed at all during the entire process.

 

For this K-1 (later interview waived for I-485) who have filed I-751 on or after December 10, 2018, they are to expect an I-751 interview based on this new guideline issued by the Trump Administration.

 

Over the next year or so, this new requirement (petitioners must be interviewed prior to filing I-751 to receive an interview waiver) will become a moot point as the Trump Administration also issued a requirement that all I-485 marriage-based must be interviewed.  This means that K-1 visa holder who later filed I-485 last year no longer was waived the interview requirement.

 

Logically, everybody who will file for I-751 will have now been interviewed during I-485, and therefore they are eligible for I-751 interview waivers, assuming that all evidence pass the adjudicator’s evaluation.

So since I'm impatient and still haven't gotten transfer notice in the mail, I decided to call the 1-800 number for USCIS and see if their automated system would provide me with the info where my case had been transferred to. Turns out it did, and apparently my case went to Nebraska. This is kinda a bummer, since Nebraska is the slowest of the offices that process I-751 =/ The waiting game continues, I guess.

11/24/2015 - Mailed I-130, I-485, and I-765
11/26/2015 - Delivered

11/27/2015 - AOS Package accepted and routed to National Benefits Center
12/03/2015 - eNotices received

12/04/2015 - checks cashed

12/07/2015 - got NOAs in the mail

12/18/2015 - got biometrics appointment in the mail

12/29/2015 - biometrics done

02/09/2016 - EAD approved

02/17/2016 - got EAD in the mail

05/31/2016 - got a text and an email notification that the interview was scheduled for June 30.

06/30/2016 - interview; green card approved; case status moved to "new card is being produced"

07/07/2016 - got the green card in the mail

 

03/31/2018 - mailed I-751 to California Service Center

04/02/2018 - package delivered

04/09/2018 - check cashed and got NOA in the mail

05/11/2018 - got a letter saying that USCIS is going to use my old biometrics

08/16/2018 - got 18 month extension letter

03/04/2019 - case transferred to Nebraska Service Center
