Hi guys, I received my extension letter almost a week ago and my lawyer received a copy of it as well, I already had an infopass scheduled for this week because the extension was taking forever to arrive and we needed to buy some flight tickets, anyways my lawyer told me to still go to the infopass and ask for a I-551 stamp, so that I can travel with the extension letter and the stamp. Has anyone has both on the same time? I normally see cases that they get the I-551 after the extension letter expired already. 

 

During my appointment I also want to ask if the ones that received a 12 month extension will be receiving a new one for 18 months or that if we are just going to have to explain that to every officer after we the extension letter expires. I also want to ask if there is something besides the extension letter that I can show to HR in case they ask about my soon to expire GC...

You don't need an infopass/stamp if you have the NOA.  The stamp is only good if your NOA is nearing expiration and you haven't received your green card yet.  No need to waste your time.  And the way that the announcement read by USCIS is that all pending cases will receive a new NOA for 18 months.

They gave him a tough time when his ead expired, even though he had given them his green card months earlier. Im just anticipating them not knowing about the extension letter and causing a stink. 



Yeah, there will probably be a stink. HR should know better, and most companies do. The extension is literally an extension adding a year onto the expiration date, his green card is valid upon presenting the extension letter. 

If they don't bend, hire an attorney, but they might just make his job harder if you do.

That’s why I was surprised - he works for a very large corporation. They have stores on every corner lol. Figured they would know better. But his HR is handled at his location and they’re totally incompetent. 

 

Hes armed with a bunch of citations demonstrating they shouldn’t even be asking to re-verify AND that the extension letter is good enough. I told him to just keep going up the chain to corporate until he finds someone who knows. Fingers crossed it doesn’t come to him being terminated and us having to deal with that.

I work at a store for a multi billion dollar business as well and I don't know how much our HR practices differ, but once his Admin/HR submits the information to attempt to terminate, it should go to one of the higher up corporate HR's that actually go through the file and decide if it's the correct thing to do. The store HR shouldn't have full control over someones case, and if they do then the company needs to revamp their system.

There also should be a way that he can find out the number for HR corporate just incase there are problems.

This is ridiculous...can't his HR do a simple Google search? The answers would be clear. Can't he show them printouts stating that is it all he needs?

Depends on how educated the HR person is. If it's a store level HR or even just the hiring manager, they may not really know nothing about any of this and don't want to risk their job on something they think might come back on them. I've worked for two large department stores, one state based store, and when it came to paperwork and things like that, it was all done through the hiring manager. The state based store I'm not even sure if there was an HR related person in the store, I just did everything with the assistant manager.

The store I work at now is a very large grocery chain in Texas and you have an Admin in every store that is trained on basic HR practices and if there's any question... well they contact the regional HR that covers the area. These people all have degrees and are HEAVILY trained in human resources, if THEY have a question, it gets forwarded to the people ABOVE them. There's no room for a possible lawsuit they might lose, how bad would it look if it got on the news that X large company is trying to fire a legal resident because they don't understand how this works.

With that said, my husband works for the same company and the only thing they're talking to him about is promotion in August. /shrug

This is good info. His location has a couple HR people, but they don’t seem to know much in general, not just with this issue. He received an email from corporate HR so he’s going to deal with them directly. I told him to continue to escalate until he finds one who understands. Also provided him with several links to I-9 instructions and handbooks that he should send them showing that 1) they shouldn’t be asking for re-verification in the first place and 2) the extension letter is good enough. I told him to cite the policies and tell them he expects to not have to deal with this again next year when the extension runs out. I know he doesn’t know anyone higher up in corporate HR so I’m thinking of suggesting he make a hotline report so that it can be investigated. Who knows how many other employees have gone through this and didn’t realize it was wrong.

 

If if I had to guess, they screwed up somehow entering his green card info originally. He had issues with them when his ead expired, even though he had provided his green card months prior. I’m wondering whether they still didn’t get it right then. 

 

As of now, he’s provided info to them and is waiting to hear back. Hopefully he will have an update soon.

You have done everything you could and they have absolutely no reason to pester him any further now. What a joke.

So now the corporate HR person is promising to follow-up providing their reasons for “needing re-verification”. So clearly they aren’t listening or understanding that they are not to re-verify green cards at all.

I would wait to hear what that HR person has to say (whatever uneducated stance they have now) and then escalate further to the HR director. I would say "any immigration attorney would be able to confirm that you are not to re-verify". Let us know how it goes.

It’s all fixed now. They realized that he was correct. Apparently they had his work authorization still listed as an EAD, not a green card. Now the local HR rep, who messed it up the first place, is supposed to fix it. So all a big mistake on their part. 

 

I kinda started thinking it was a mistake because this company employs 200,000+ people. How could they have this wrong, ya know.

Excellent news. Bitter feeling from that HR agent who initially messed it up though, and they could not even admit this and made you worry instead.
