Hello guys, please I need your help. I had a pending i485 that was filed by my husband by my soon to be ex- husband who has now deserted me. I have filed my VAWA application based on the pending i485 but just received a notice that the pending i485 has been denied. I haven’t received the notice but I suspect he probably withdrew his sponsorship. I have a pending VAWA that has been received and I have even received a prima facie approval. 

Should I appeal the denied i485 or should I just file a new one with the Vermont office. He is a USC. Thanks for your help.

Timeline

Now that the initial i130- based i485 is denied, you may file a new VAWA based i485 rather than going thru appeal process.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Presumably there is a lot more to this than being deserted.

Please @sandranj  @arken I have another question? I filed/renewed my i765 based on my pending i485 that has now been denied and the i765 has been accepted by Vawa unit and also received a notice that biometrics isn’t required. When I file the new i485 should I attach the accepted i765 notice and write explaining the situation or should I file a new i765 with the new i485.
