Questions about I134

Hi, first of all sorry for the double post, we were editing it but it did not let us do it anymore.

We just got our NOA2, we're pretty excited but we are having some issues I134, we have checked the instructions and found some answer but we still have some unresolved questions.

 

I just moved out of my moms and I still have not legally changed my address. I do not want to put down a random new address on the I-134 without notifying them that I have moved. Is it too late to notify them of my address change? I want it to be known that I can afford to live on my own.

 

On form I-134 Part 3 income and asset information, do I include the value of my car for number 5. Value of my other personal property? I own my car, do I put the current value of the car or the value when I purchased it?

 

For the annual income part I want to make sure I make enough. I can´t find the required income for a household size of 1. My fiance is in his home country so I do not pay for him. I am also wondering since my address still says I live with my mom should I include her in my household size even though she makes more money?

 

Should I put my work’s headquarters or just my actual location? It is a chainstore.

 

My fiance got a Driver’s license, the AXXXXXX that appears on his ID is the so called “A number”, right? Is it still valid even tough the ID is expired?

 

We don’t understand the last question, page 4, part 3, #38. What “specific contribution means”? My fiance has some money saved up, is it ok if I mark no or would it make our case weaker?

I own my car, do I put the current value of the car or the value when I purchased it? Believe this needs an official appraisal like a home would be if using it as any asset/value, not just an assumed value but it would go off current value not "brand new" since even if you bought it brand new, as soon as you drove off the lot with it it lost value.

Unless you support your mom, which doesn't sound like it. Your household will be two people, you and your fiance since you're the sponsor and they are the beneficiary. So for two I believe the 100% line is about $20,500? Somewhere in that area. Remember though too for AOS it is 125%. Their current income and even savings aren't taken into account on the I-134. Now if they have savings and later combine it in your bank account after marriage, it could be used as evidence of savings for the I-864 during AOS.

 

Should I put my work’s headquarters or just my actual location? It is a chainstore. I'd put actual location with information specific to your manager and all. Your HR can just write up the letter of employment though and put whatever information they legally see fit.

We used my husbands "A" number though and he had a SSN from previous J-1s so..

It is up to you the sponsor the show you can support them.

A number is the alien registration number in case he/ she has ever been or is in the US

 

 

Item Number 2. A-Number (if any). Provide your beneficiary’s A-Number. Your beneficiary may have an A-Number which is used to identify his or her immigration records. Your beneficiary can find this number on documents he or she received from USCIS, ICE, CBP, EOIR, or DOS.

There is no "legal Change of Address (COA)". :P You just need to put down where you currently live. Whether that's with a parent or on your own isn't something to focus on. They will care about your income / assets.

There is no household size of 1 for the I-134 (or I-864 for AOS later). You must always include at least yourself + all people being sponsored by the affidavit of support. So the smallest household size is 2.

The I-134 is only a tool to help the CO make a public charge consideration. Many go by the 100% income level, some want to 125% of the income level (like is required for the I-864 later), and some want to see even more as they all look at the totality of the circumstances in making their decision.

 

Your mother is (presumably) not dependent on you, and therefore doesn't need to be included in your household size. The I-134 instructions are pretty barebones...the I-864 instructions better clarify who to count in your household size.

Either is fine really, but I'd personally go with the local one.

It doesn't really matter here either (the I-134 is not specific to a K-1), but I marked "Yes" and clarified this on the last page with "N/A (K-1 Visa Process)". I don't think that was necessary, though.

Thanks for the replies, we decided to use a joint sponsor for I134, does that mean that we need to fill two I134 forms? Or just one and I, the US fiance are the petitioner and our joint sponsor is the sponsor?

 

Also, does the debt influence for the joint sponsorship?

One I-134 from each sponsor. A handful of consulates will take one from only the co sponsor, but most want it from both.

 

No, they will look at the income and/or assets listed on the form + the rest of the circumstances available to them. Personal debt is not something that needs to be declared (only net value of assets used, if any).

My income has changed drastically over the last 3 years, what do I write on annual income? just the income of 2017 or a median?

and question 4  balance, does that include my credit card limits? Should I put that for my balance of savings and checking accounts?

I've seen people use a signed photocopy without issue, but I've also seen reports of getting a 221g. Unlike USCIS and NVC who will accept photocopies for it, the CO makes the final call and may or may not want an original. I would suggest getting an original there just in case.

Your income is your current income. If you are a typical wage earner / employee for a company, this is what you expect to make in a 12 month period and can be supported by the provided documentation (pay stubs + employment letter). If you are self-employed, have investment income, or rely on tips/commission/bonuses/etc., then this income would be whatever you claimed as income on your 2017 tax return.

 

Assets do not need to be listed unless you are using them to qualify (income is insufficient by itself). Credit card limits and personal loans and such don't need to be listed on the I-134. If using assets, they need to see evidence of that income, not anything to do with how much you can borrow.
