Getting Congressman/Senator involved in Process

Timeline

Hi All,

I have seen in the past a few of you contacting your local congressman/senators to intervene in Applications.

 

My situation is - I anticipated that my EAD/AP application would be approved (well the i765/AP Combo card) within 90 days as I was informed by USCIS just before I submitted.

My application and 797's were received Jan 9, 2018. - which would make 3 months, April 9, 2018.

My brother's wedding is in Canada on April 27th and Im thinking that my card may not be back by then. I am currently at 83 days ("Case was Received") and my Biometrics was completed on Feb 9.

 

Do I or my wife contact our representatives? anyone completed this before? and any tips on what to say/ask etc.

I have already completed a SR online too.

12/16/2017 - Married

1/06/2018 - AOS Package (I-130, I-485, I-765, I-131) Sent via USPS - Chicago Lockbox 

1/10/2018 - AOS Package "Delivered" at Chicago Lockbox - After 2 delivery attempts.

1/12/2018 - Official Priority Date.

1/17/2018 - NOA1 electronic copy received - 4 Email and Text notifications (12:30am EST)

1/22/2018 - NOA1 Hard Copy Received

1/26/2018 - Biometrics Appointment letter received - 2/9/18 (For I-485/I-765)

2/09/2018 - Biometrics completed - Charlotte office - Very efficient!

5/30/2018 - Notification of i-485 Interview scheduled 

6/4/2018 - Interview notice arrived in Mail (July 9)

6/4/2018 - Called to request transfer case to Seattle (Moving June 25)

6/14/2018 - I-765 - Card is being Produced (Day 156)

6/21/2018 - EAD Card delivered (USPS tracking sent 2 days earlier)

6/28/2018 - Confirmation of Interview Cancellation

3/08/2019 - Re-Applied for AP/EAD extension (Exp Date: 6/13/2019)

I think you are still within normal processing.  There is a very good chance that your EAD will not arrive before the wedding.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Contact your congressman or senator's office and explain the situation. If I were you, I'd pick the one who I thought would be most sympathetic to immigrants... cough cough. I have had very positive experiences thus far with my AOS and with previous issues with my reps - they've always offered to do the heavy lifting for me, but clearly that's not a universal experience.

 

A brother's wedding in Canada, of all places, after patiently waiting 100 days is a good enough reason for emergency AP.

You are most likely still going through background check, which USCIS does not handle themselves rather submit to the FBI. Right now, the average approval is 77 days after Biometrics, 11 weeks after the Biometrics Appointment. It is not very likely that you will the AP on time.

 

You can always try to get it to be expedited, but USCIS already kind of has a response for that on their website (quoted below). But if there is any extra amount of things in consideration, or unplanned factors that would help your case, you can apply for it to be expedited, remember than in some cases your Congressman's hands could be tied if USCIS makes a decision not to expedite it.

AOS with pending I-130 (F2A):

March 2, 2018: AOS Package PD (I-485, EAD, AP)

March 14, 2018: NOA1  / E-Notification // Physical Mail: March 20, 2018

March 17, 2018: Biometric Appt Notice received //  Appointment: April 6th

March 29 RFIE // April 11 USCIS received RFIE response

May 10, 2018: I-130 Approved  :D *But case sent to NVC*

July 11: INFOPASS Appt + Sent Additional Documents

July 20: Case Ready for Interview (Finally!)

August 14: Card being produced //  August 22: Combo Card in hand
