Certificate if Finality sufficient?

Hello, im joanna and im a new member here. So here's my question:

 

I just received my Certificate of Finality from my lawyer. Me and my fiance are planning to start our K1 application, would the Certificate of Finality will be sufficient or do we have to wait till we get my annotated marriage certificate (null and void) from the PSA (Philippine Statistics Authority)?

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Timeline

The question you have to ask yourself is: 

 

Am I now free to marry IN the Philippines?  

 

The answer to that question is the answer to your question.

 

Main requirements for filing the K-1 is; 1) Free to marry.  2) Met in person within the past  years.

 

USCIS doesn't know the laws of the Philippines so they may "assume" certain things and approve your petition.  USEM does know the laws of the Philippines in regards to being free to marry, if you were not free to marry at the time of filing the I-129F they will return your petition to USCIS, not allowing you to proceed with the interview.    If you are good to get married with the certificate of finality .. then all is fine for filing.

In our case, we filed for the K-1 with a PSA stamped CENOMAR and we received an RFE for the actual court documents from the annulment.  That was from USCIS.  

 

At the interview stage you are required to show the CENOMAR but at Medical Rose was required to present the original Annulment paperwork.  They are looking for the reason sited for the annulment.  If the beneficiaries "psychological incapacity" is the reason for the annulment there will be additional questions and a psych evaluation.

 

I would include the annulment paperwork from the court that has the judges signature.  That will save you from having to present that for an RFE at a later date.  

 

In music production we say "garbage in - garbage out".  Put together the best package you can and things will be smoother for you down the road.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

We are planning to use paralegal (Rapidvisa) for a hassle free application. Good luck and God bless on your fianceé's interview. I'll include you in my prayers. 😊

If you found this site you have more than enough help to do it yourself.  We used Rapidvisa and I really can't complain BUT, they did nothing I couldn't do myself with the support here.  In the long run, they are a waste of money but did give me some comfort with a very confusing process.  After I found this site I realized that the experience here would help me more than Rapidvisa ever could.  

 

I am not upset that I used them but the forms are easier than you think.  I will not use Rapidvisa for AOS.

 

They do not understand the process in Manila and will give you bad advice (that may be fine for other Embassies).

You must have the annotated marriage certificate from NSO for the CO at the Philippines window. He/she will look over your paperwork and make the necessary determination that you have everything that the Philippines requires and once signed off you go on to the American window for your interview. You must get the annotated marriage certificate. Most cases it takes less then 30 days.

They are asking regard filing the I-129F.   Is the PSA copy needed.

When we were doing our I-129F we proceeded after receiving the COF but by the time the interview rolled around we had the AMC. This is an area that I would becareful of "Gotcha's" and you know what I mean.
