Hello,

 

I've just started researching the whole K1 to wife that is able to work process and I have a few questions after reading through the guides :-)

 

1. I can't figure out if my overseas Fiance needs to submit any docs that require translation as part fo the i-129.  I expected a birth certificate at minimum, but that does not seem to be the case (her case is simple - no past marriages / kids / legal troubles). Can anyone confirm?

 

2. I'm a little confused around the process (and timelines) for my Fiance to get permission to work in the states.  If I'm understanding correctly: 1) Get married once Fiance is in the states, 2) Submit i-765 to get EAD/SSN within 90 days of entry (can likely speed up process by having fiance proactively go in to get biometrics), 3) Submit i-485 to adjust to permanent residency and start green card process.

- Question: The EAD can take-up to 90 days and the i-485 is listed up to 18 months for my city. Does this mean the Fiance can't work for up to 18 months?

- Question: We plan on doing a court wedding and then 1.5 years later doing the big ceremony.  Does this impact her chances to get a green card? (if it matters, she is from Japan)

 

3. Has anyone put together a detailed guide for the entire K1 submission to working and green card holding wife?  I know there were a few guides... but information still seems a bit scattered.

After the fiance arrives your steps are

1. Get married within 90 days. 

2. File for ead,  ap and AOS as ONE packet. You send it out together. Her work permit might take 3 to 4 months to arrive and then she can start working. Green card takes about a year. 

 

The guide here on VJ is pretty good and can't get any simpler than that. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Once she enters US on her K1 visa (and after you marry) you need to follow this to do AOS.

Always make sure to download the latest forms from the USCIS website.

 

PS: If you file for the AP (i-131) and EAD (i-765) together (when you file for AOS i-485) she most likely will receive a combo card that serves for both purposes.
