Timeline

Hi

I have just returned to the US to start the K-1 Fiancée process.  We can't be married in Thailand as Thailand won't recognize Ladyboy/man marriage. We have lived together in Thailand for the past 3 1/2 years and she wants to get married, so....

Anyone have any experience with bringing a Ladyboy finance to the US on a K-1?

Your first step will be to visit USCIS.gov and print out a form I-129F to apply for a K-1 fiancé/fiancée visa. The main requirement for a K1 visa is you guys must be ready to marry within 90 days upon entry to the U.S. and also have physically met in person within the last 2 years prior to filing the petition.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

3/14/2015: Green card delivered.

Removal of Conditions: 

12/14/2016: Mailed I-751.

12/19/2016: NOA issued.

01/26/2017: Biometrics.

05/03/2018: I-751 transfered to NBC.

02/27/2019: Joint I-751/N-400 Interview.

05/14/2019: I-751 APPROVED.

Naturalization:

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!

Yes, I have the forms and most of the documents I need to submit.  Patti is flying to Isan next week to obtain her birth certificate and single status docs.  

I was wondering if I should be concerned regarding the same sex finance issue.

Patti hasn't worked in the 5 years since we got together.  I supported her when she returned to her village in Isan while I returned to the US for business.  Before that she worked as a waitress in the restaurant on the bottom floor of the Tower Building in Bangkok.  I returned in 2014 and we have lived together in Southern Thailand since then. We both figured it wasn't worth her working for 60 hour weeks for 6000/7000 baht a month.  I have adequate income to support us in Thailand or the US.

My (poorly worded) question was if any member has any experience bringing a same sex partner (Ladyboy in this case) as a fiancé to the US via the K-1 process.

Lots of same sex couples on here, probably best not to use the Ladyboy term as it will imply a certain profession.

The bangkok embassy is very well equipped to handle the situation with a LB.. much better than here in the states where immigration officers will refer to her as a him and look at them strange when their passport says male.

 

But get your ducks in a row.. have a lot of photographs and evidence and you can get the K-1 visa easily.

 

But make sure your bank accounts for the time you spent in thailand do not look like a bargirl (i.e. random deposits of 20k-50k baht). I had a friend who was denied his lb fiance a visa on that basis.
