Declariation of HOW WE MET (signatures)

Timeline

I'm just starting the process and got stumped on the declaration on "how we met"

 

According to the guide on http://www.lovevisalife.com/2017/06/k-1-visa-application-assembling-tips/, their example has a section for the fiancé to sign.

 

Since my fiancé is in Europe, can this be submitted without a "wet signature"

 

Also looking ahead to the Intent to marry within 90 days section, their example also has a spot for the fiancé to sign.


Anyone know if they can just email this back to me or is their signature even required?

 

HELP!!!

Declaration of how you met doesn't need to be signed by fiance, but your wet signature on the form will apply to your answer to that question.  If you add a page as an attachment to answer that question it's also good form to sign and date the attachment.

 

Wet signature from fiance IS required on the intent to marry.  They will need to send a hard copy to you and you will need to send a hard copy verifying continuing intent to marry before fiance's interview at the consulate, along with financial records proving you can support them.

 

If you submit without a wet signature you'll get an RFE.

Here is the relevant part of the memo:

 

"A signature is valid even if the original signature is later photocopied, scanned, faxed, or similarly reproduced. Regardless of how it is transmitted to USCIS, the copy must be of an original document containing a handwritten, ink signature, unless regulations or the form instructions state otherwise. 3 USCIS will not accept signatures created by a typewriter, word processor, stamp, auto-pen, or similar device."

I challenge you to find one case within the past few/several years that got an RFE for a wet signature on the letter of intent to marry. ;) This requirement was scrapped years ago.

 

An individual CO may request one for the interview later, but that would result in a 221(g) and AP, not not an RFE. RFEs are only issued by USCIS.

A separate declaration of how you met is not ever required, but can be used if the reason doesn't fit on the I-129F itself. They aren't looking for a long story or a history of your relationship. They just want to know how you met within the past 2 years, which will need to be supported by the evidence you provide (boarding passes, passport stamps, receipts, etc.).

What about the proof that you can support them?  Should I be sending my last 2 paycheck stubs?  On the guide, there is nothing listed asking for financial support proof as described by Hawksquil above

The I-134 (Affidavit of Support) is presented at the embassy interview. It is not submitted with the I-129F...it (and supporting evidence like paystubs) would be long outdated by the time of the interview anyway.

Edit: Note that the embassy follows DOS policies, which can have different signature guidelines. They may or may not want a wet signature for the I-134.

Yes, I meant that when the embassy interview comes, you will need to send the affidavit of support along with a letter saying you are still willing/able to marry them.

 

Unless this has changed since 2016/2017, of course.

The best resource for instructions of what to include with the I-129F and how to submit it is to carefully read the I-129F instructions and the USCIS Filing Tip instructions.   Unless they are not explicitly mentioned in the instructions, additional documents are not required.  Additional documents may (and will) be required at the Embassy stage, such as the I-134 that @geowrian has mentioned.

Whoops, the requirements have clearly changed since I first started researching K1 - apologies for any confusion.

 

I definitely remember reading about people who got RFEs for wet signatures, including one couple I know in real life, but that would have been in about 2013-2014?  Time flies!  ;)

As long as you include the month and year when you first met in person and a very quick summary of the circumstances (such as that you were working in the US as an au pair), that should be enough.

Thanks for your quick answer! :) 
We only said that we met when I was an au pair and the year. Plus we incl. a copy of my J-1 visa and where I was staying. We didn't describe the meeting further.

I hope that's still enough :o
