I129f PD - 05/20/2019 - nebraska

why we filed K3 - it is free and we noticed that when both were filed I130 had tendency tI be approved faster. And both path were good for us.

06/21/2019 - our I129f petition got denied - reason stipulated in official letter : I130 got approved so you don’t longer need this one. We didn’t receive the official I130 approval yet but if this is truth we got approved in Nebraska in less then 3 months.

We didn’t file for expedite, my husband is not military, we didn’t contact congress people. I129f is the only other path we took.

Oh wow.. why didn't I file the 129f after I did the i130.

Now we are all in doomsday

I imagine the frustration ! We just decided to try to use any legal means to try to speed up the process and be together. This path was the only one we found after our case was send to Nebraska. My I130 got approved a month after I send my I129f so maybe you can still try...

February 13 2015: Started dating (met in New Orleans)

February 13 2018: Married in New Orleans

March 29 2019: PD for 1-130 (Spouse) - Nebraska Service Center

May 20 2019 : PD for 129F (K3 spouse visa)

June 21 2019 : I129F denial

June 22 2019 : I130 APPROVAL (only 85 days after submission) 😀 

July 17 2019 : sent to NVC by NSC

September 03 2019 : received case number (72 days after approval - it was a long 10 weeks waiting time  😶)

September 06 2019 : payed fees 

September 11 2019 : uploaded documents (Financial & civil) + submit DS-260

October 17 2019 : documents reviewed by NVC - one document missing / others approved (first review after 35 days / 5 weeks)

October 21 2019 : missing document submitted (police certificate from another country I lived in - this country is requiring 2 different police certificates and I only had one...stupid mistake)

November 22 2019 Documentary Qualified email :D 

December 10 2019 Medical done 

December 16 2019 Interview Letter

January 22 2020 Interview - APPROVED 😍

January 28 2020 Visa on hand 

February 25th 2020 Travel day

Yes it really is.  It's a lot of everyone here who filed with Nebraska

Too late to file i129f 😐

Also the thing is that I hear lots of negative stuff about the k3. Anyways it was a conversation on here. But I don't want think about that now.

No we didn’t hire a lawyer. All by ourselves :) good luck to you! It is coming soon

I just filed my wife's I-130 (PD June 6, 2019) and I am wondering if this is a worthwhile route to take to speed up the process 😲

Upon my experience yes. 

You should try - there’s no fee on I129f if you apply for your spouse. It is basically same information and paperwork (even lighter) so I would go for it.

just for you to take into consideration: K3 visas are issued in a really small amount of cases, but in order for them to deny it, they have to approve your I130 first. But if your I129f is approved first your spouse will have 3 months to join US on a non immigrant visa and then apply for AOS. It is more expensive road then straight I130.

Thank you for the information.  I think it is a Win-Win in case of approval of K3/AOS or rejection of the K3/approval of the I-130

It's really too long, why i130 takes so long to process. They don't know we have to go other steps.  It's ridiculous.

Also, on a K3 visa you spouse cannot work and travel overseas right away, they have to apply for AED and AP and it takes a few months. But it seems that they don't give K3 anymore anyway, they just go straight to approve the I-130.

Sorry but I think k3 is unfair to those who are waiting so long. 

 

June, July, August, September, etc filers are waiting in limbo while Nebraska Service Center is busy giving away approvals for this year i130 and k3 filers. Sorry but I feel it.

It's been a year.

And you know we have been waiting a year only to get an rfe in some cases.

 

This is suppose to be like some kind of hidden shortcut or key.. how are we supposed to know about this when we first filed our i130s.. why uscis is doing this to us. 😭

Hey guys, December filer here.

I was wondering since approval times take so long now, we might get pass our 2 years anniversary , if we get approved approximately in December by USCIS  will we get CR visa or IR visa? At what stage do they pick if it's CR1 or IR1? Also how much time do you have before you need to leave to US? It's hard to plan moving to another country that blindly.

NOA2:  09/25/2019

Sent to NVC: 10/07/2019

Case number assigned and received: 11/05/2019

Fees paid: 11/07/2019

IV changes to paid: 11/12/2019

AOS changed to paid: 11/20/2019 (after calling NVC)

DQ 02/27/2020

Interview: 06/30/2020

Approved: 07/02/2020 (Medical exam delay)

Visa received: 07/10/2020

 

I-129f

Sent: 08/30/2019

NOA1: 09/03/2019(LIN)

NOA2 denied 09/25/2019
