I definitely agree with you all, I also see the side of desperation and willingness to try anything legally possible also. 7/10 1st NOA and I think we will continue sticking out the I-130. It's all so ridiculous we are all even having to deal with this nonsense. I'm trying to look at here and FB less and concentrate on life, but it's definitely hard...

In the end it’s all about what is the best for each couple and their families, no need to fight or blame anyone for anything, every family has different needs and well  no one is forced to do this process one way or the other. As long as it’s a legal way which K3 is then I don’t see the need for people to be chewed out for it, anyone is able to do it it’s every individual’s choice whether you want to or not, no need for fighting each other about it, we are not each other’s enemies, we are all just people desperately wanting to start our lives with our spouses and/or families yet all stuck in the same flawed system here in the end.

  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)

  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid

  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Right now it’s 10-13 months but for most people right now it’s taking around 11-12 months. They are slowly chugging through July now I think

Our CR1 Journey:

My wife and I are July 10th 1st NOA and still nothing. Looks like most are nearing the 1 year point, if not a full year or just over. It's sickening, but I feel we are FINALLY getting close.

Once a case is with an officer, I would think it wouldn't be long until an answer right?

 

Some folks are very close.  They're working on end of June and up to July 12th also..

Once it’s with the officer they do background checks etc. so yes it should process fairly quickly unless they run into a situation where something causes them to dig a little deeper.

Oh, this is not about people like you where it makes sense to apply for a K3 as you are already living together abroad. These people are expecting their K3 to be denied as they have already filed IR1/CR1 which is the more appropriate application in their case. They are just hoping to cut the line.

Keep in mind that this controversy around the K3 visa is once again due to USCIS not doing their job properly. The petition for K3 visa was originally intended to be filed concurently with the I-130 and be approved faster so the spouse living abroad could come to the US while the I-130 was being processed and avoid long separation. If USCIS was doing it's job properly, they would do just that and no one would be angry at those getting a K3 visa. But it seems to me that the I-129 petition comes up with priority on their list (which is logical given it's original purpose), but instead of approving it for a K3 visa, they go look for the associated I-130 petition and process that one directly instead. In a way it makes sense, they save time by doing the job only once, but it's screwed up. I don't think filing the I-129 is going to increase their workload since they don't look at it. But if everyone does it, it's not going to help in the end.

Yes true.. then they can take longer if they want to check more. But I would think they do the background check before it gets to an officer.

How would the background check be done before the case officer looks at it..huh..it’s sitting in a pile waiting to be looked at by the officer. Once they get it they will review the file and run background checks. So not sure what you mean.

Ohh ok, so officer will do that checks and reviews. I wasn't sure.
