No one wishes you to never see your parents/family again...we all know what it's like to not be able to travel back to our country of origin when a family member is sick, or dying, or going through something traumatic and your first instinct is to "be there".  Or even the first instinct to "be there" when something joyous is happening.  Please don't discredit even those who may have seemed more harsh in their responses (or gave opinions you did not particularly like)...there's some knowledge to be gained from everything.  

 

Honestly----I wish the best for you, and I hope that you can visit with your parents frequently---just be prepared of the strong possibility for your visits to be within Canada.

Completely disagree, many people enjoy berating others as it gives them the sense of power they lack in their daily non-internet lives. Sad

 

As for the OP, if you are in love with a USC just marry them for your quickest entry. Prepare for your marriage to be heavily scrutinized due to your past overstay.

Though the answer might seem harsh it is factual.  The ban is automatic and the timelines for your alternative paths are accurate.  Sorry about your situation.  Overcoming a ban is hard - your parents (and anyone else who petitions you) would have to demonstrate a credible "extreme hardship" which will be very difficult for them to prove.  Based on what you have said extreme hardship to your parents or brother if you are unable to immigrate will be nearly impossible to prove.

 

Many of us waited apart from our spouses and family members for months while our petitions were processed, with no chance of time together unless we ponied up vacation time and tickets and travelled to see them.  Those of us that did shake our heads when we hear stories like this.  We really are your peers and if there was a way to help you we would.

As a Canadian citizen I doubt the marriage would be scrutinized. I know about 3 canadians that got d3nied entry and married with no issue. It's a low fraud country. 

The other thing is Canadians were entered as a D/S which means duration of stay? Their is a part in the rule book that says Canadians entered as D/S are duration of stay and exempt from the 3/10 year overstay.

Yes, if they were not issued an I-94 then they are considered D/S. But if they were issued an I-94 with a 6 month expiration, then the overstay bar still applies.

Gotcha. So if she goes online and has an electronic i94 then the bar could apply? I know pre 2013 Canadians never got an i94 but things have changed. 

But I agree getting a visa anytime soon will be hard. I know border patrol keeps notes and these will be in their notes

Yes, the I-94 should be online if it was after that started doing electronic I-94s vs the paper ones. It's good to check and confirm at least. It doesn't fix the misrepresentation issue, though.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
